        The writ petition is filed seeking the<\/p>\n
following reliefs.\n<\/p>\n<\/p>\n
        i)  Set aside Ext.P3 order by issuing any<\/p>\n
appropriate writ, order or direction.<\/p>\n
        ii)    Issue such   other  writ, order or<\/p>\n
direction, which are deemed fit and proper on the<\/p>\n
facts and circumstances of the case and in the<\/p>\n
interest of justice.\n<\/p>\n<\/p>\n
        2.   Petitioner is the judgment debtor in<\/p>\n
E.P No.119\/2008 in O.S No.500\/2004 on the file of<\/p>\n
the Munsiff Court, Palakkad.     Suit was one for<\/p>\n

money.      The respondent \/ decree holder, during<\/p>\n
trial had filed an application under Order 38 Rule<\/p>\n
5 of the Code of Civil Procedure for interim<\/p>\n
attachment of a motor vehicle belonging to the<\/p>\n
petitioner \/ defendant in the suit.       The defendant<\/p>\n
entering appearance before the court and requested<\/p>\n
the vehicle to be treated as the security with<\/p>\n
undertaking that it will not be alienated.        After<\/p>\n
passing of the decree, when steps were taken for<\/p>\n
arrest of the petitioner, he appeared before the<\/p>\n
court.     In the enquiry, it was revealed that the<\/p>\n
vehicle     had been alienated.     The learned Munsiff<\/p>\n
thereupon passed Ext.P3 order after issuing arrest<\/p>\n
warrant against the petitioner \/ judgment debtor.<\/p>\n
Propriety     and   correctness  of   Ext.P3  order  is<\/p>\n
challenged     in   the  writ  petition   invoking  the<\/p>\n
supervisory jurisdiction vested with this court<\/p>\n
under Article 227 of the Constitution of India.<\/p>\n

          3.     I heard the counsel on both sides.<\/p>\n
Having regard to the submissions made and taking<\/p>\n
note of the facts and circumstances presented with<\/p>\n
reference to Ext.P3 order, I find the procedure<\/p>\n
followed by the court below directing issue of an<\/p>\n
arrest warrant against the petitioner for violating<\/p>\n
the   alleged     undertaking   given    by him  without<\/p>\n
affording him an opportunity for explanation cannot<\/p>\n
be sustained under law. Some observations made in<\/p>\n
Ext.P3 order that the conduct of the judgment<\/p>\n
debtor was nothing short of contempt, that too<\/p>\n
without hearing him cannot be approved.         Whatever<\/p>\n
be the contumacious conduct of the judgment debtor<\/p>\n
in disposing of the vehicle violating the order of<\/p>\n
undertaking given a court of law, the court cannot<\/p>\n
reach in conclusion or enter a finding without<\/p>\n
providing him an opportunity to explain and also an<\/p>\n
opportunity of hearing.        Further more, the court<\/p>\n
below   cannot     also    enter   a   finding that  the<\/p>\n
violation     of    the  undertaking    is  a  contempt.<\/p>\n

Contempt proceedings are to be taken only after an<\/p>\n
enquiry and the subordinate courts, after such<\/p>\n
enquiry, has to address this court for taking<\/p>\n
action under the Contempt of Courts Act if cause<\/p>\n
thereor is made out.       Whatever that be, at the time<\/p>\n
of hearing the writ petition, the counsel on both<\/p>\n
sides    have    reached   a  consensus    by  which the<\/p>\n
petitioner agreed to pay the decree amount due in<\/p>\n
two instalments.        Petitioner has agreed to pay a<\/p>\n
sum of Rs.25,000\/- within a period of 45 days from<\/p>\n
the date of the judgment and the balance amount<\/p>\n
outstanding      on    the  decree    with   expenses in<\/p>\n
execution within a further period of 45 days.<\/p>\n
Submission made by the counsel for the petitioner<\/p>\n
as above is recorded.        In the event of default in<\/p>\n
payment    of   the    decree  debt   as   agreed to and<\/p>\n
represented      by    the  learned     counsel  for the<\/p>\n
petitioner, it is open to the decree holder to<\/p>\n
proceed for realisation of the entire decree debt<\/p>\n
in the execution proceedings as provided by law.<\/p>\n

Ext.P3 order is set aside reserving the right of<\/p>\n
the decree holder to take appropriate steps under<\/p>\n
Order 21 Rule 37 of the Code of Civil Procedure in<\/p>\n
the event of default of petitioner to pay the<\/p>\n
decree debt within the time limit as agreed and<\/p>\n
fixed as above.         In case the petitioner commits<\/p>\n
default in paying the decree debt as agreed upon, I<\/p>\n
make   it   clear    that  he  will    be liable  to  be<\/p>\n
proceeded for violating the undertaking given, as<\/p>\n
provided by law, apart from the proceedings for<\/p>\n
realisation of the decree debt.\n<\/p>\n<\/p>\n
              4.    Subject to the observations made,<\/p>\n
the writ petition is closed.\n<\/p>\n<\/p>\n
