DENESAN, J.\n\n\n\n             = = = = = = = = = = = = = = = = =\n\n              W.P.(C) Nos.3536 &amp; 3553 OF 2007\n\n             = = = = = = = = = = = = = = = = =\n\n\n\n              Dated this the 6th February, 2007\n\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioners in these writ petitions are having<\/p>\n<p>identical   nature   of   grievance,   viz.,   that   their<\/p>\n<p>services   are   proposed   to   be   terminated   without   valid<\/p>\n<p>reason.\n<\/p>\n<p>     2.   Ext.   P1   is   the   order   of   appointment   by   the<\/p>\n<p>District   Project   Officer,   Sarva   Siksha   Abhiyan,<\/p>\n<p>Kozhikode.     That   order   was   issued   on   26-11-2003.     In<\/p>\n<p>paragraph   2   of   the   appointment   order   the   following<\/p>\n<p>terms and conditions have been specifically stated:\n<\/p>\n<p>     i) The appointment is purely temporary.\n<\/p>\n<p>     ii)   For   the   work   done,   the   petitioners   will   be<\/p>\n<p>entitled   for   a   daily   wage   of   Rs.120\/-.           If   the<\/p>\n<p>petitioners&#8217;   services   are   found   not   satisfactory,   the<\/p>\n<p>District   Project   Officer   will   have   the   right   to<\/p>\n<p>terminate the services without notice.\n<\/p>\n<p>     3.   Relief   prayed   for   by   the   petitioners   include   a<\/p>\n<p>writ   of   mandamus   directing   the   respondents   not   to<\/p>\n<p>terminate the service of the petitioners.\n<\/p>\n<p>     4.   Counsel   for   the   petitioners   contend   that   the<\/p>\n<p><span class=\"hidden_text\">WPC Nos.3536 &amp; 3553 \/2006         -2-<\/span><\/p>\n<p>appointment of the petitioners cannot be traced to Rule<\/p>\n<p>9(a)(1)of   K.S.   &amp;   S.S.R,   and   that   being   the   position,<\/p>\n<p>the   respondents   cannot   terminate   the   services   on   the<\/p>\n<p>expiry of any fixed period.\n<\/p>\n<p>        5.   It   is   true   that   the   appointment   cannot   be<\/p>\n<p>traced to Rule 9(a)(1) of K.S. &amp; S.S.R., but that will<\/p>\n<p>not improve the case of the petitioners.  The terms and<\/p>\n<p>conditions incorporated in Ext. P1 would show that they<\/p>\n<p>are   more   disadvantageous   to   them   than   an   appointment<\/p>\n<p>made in terms of Rule 9(a)(1) of K.S. &amp; S.S.R.   Having<\/p>\n<p>accepted the employment based on the terms in Ext. P1,<\/p>\n<p>the   petitioners   cannot   be   heard   to   contend   that   they<\/p>\n<p>are   not   bound   by   the   terms   and   conditions   thereof.\n<\/p>\n<p>Since   the   petitioners   have   no   legal   right   to   continue<\/p>\n<p>in   employment   unlike   those   appointed   to   a   post,   these<\/p>\n<p>writ   petitions  are  devoid  of  merit.    Accordingly,  they<\/p>\n<p>are dismissed.\n<\/p>\n<p>                                                  K.K.
