The alleged offences are under Sections 328, 326, 143,<\/p>\n<p>147, 341, 365 and 120(B) of I.P.C. According to prosecution,<\/p>\n<p>sixth accused made a phone call to the defacto complainant,<\/p>\n<p>who was engaged in dealing with cinema CDs and asked him<\/p>\n<p>to come to Mermaid Hotel. Accordingly, defacto complainant<\/p>\n<p>along with 3 others went to the hotel, from where accused nos.<\/p>\n<p>1 to 6 wrongfully confined him in a room and made him to sign<\/p>\n<p>certain documents purported to be an agreement for the<\/p>\n<p>transfer of the newly created cinema CDs. They were locked<\/p>\n<p>up in the room for 5 days.\n<\/p>\n<p>     3. Petitioner is the second accused. The incident<\/p>\n<p>occurred on 26.11.2008 and petitioner was arrested on<\/p>\n<p>21.12.2008. Learned Public Prosecutor submitted that he has<\/p>\n<p>no objection in granting bail to petitioner but, conditions may<\/p>\n<p>be imposed.\n<\/p>\n<p>     On hearing both sides, I am satisfied that bail can be<\/p>\n<p>B.A.No.365 of 2009<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>granted to petitioner on conditions.<\/p>\n<p>       Hence, the following order is passed :<\/p>\n<p>         Petitioner shall be released on bail on his<\/p>\n<p>         executing bond for Rs.25,000\/- with two solvent<\/p>\n<p>         sureties each for like sum to the satisfaction of the<\/p>\n<p>         Magistrate court concerned on the following<\/p>\n<p>         conditions :\n<\/p>\n<p>           (i) Petitioner shall report before Investigating<\/p>\n<p>                Officer on every Monday, Wednesday and<\/p>\n<p>                Saturday between 10 a.m. and 1 p.m. until<\/p>\n<p>                further orders.\n<\/p>\n<p>          (ii) Petitioner shall not influence or intimidate<\/p>\n<p>                any witness or commit any offence while on<\/p>\n<p>                bail and in case of breach of this condition,<\/p>\n<p>                bail is liable to be cancelled.\n<\/p>\n<p>       The petition is allowed.\n<\/p>\n<\/p>\n<p>                                K.HEMA, JUDGE<\/p>\n<p>pac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Bharath vs Sub Inspector Of Police on 29 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 365 of 2009() 1.
