BASANT, J.\n              --------------------------------------------\n                     B.A. NO. 7133 of 2007\n              --------------------------------------------\n        Dated this the 21st day of November, 2007\n\n                              ORDER\n<\/pre>\n<p>      Application for regular bail.        The petitioner is the 1st<\/p>\n<p>accused. Altogether, there are 4 accused persons. They face<\/p>\n<p>allegations for offences punishable, inter alia, under Secs.308<\/p>\n<p>and 326 read with Sec.149 of the IPC.                The crux of the<\/p>\n<p>allegations against the petitioner is that he along with four<\/p>\n<p>other accused persons, on account of prior animosity, attacked<\/p>\n<p>the de facto complainant. He was beaten and kicked. A stone<\/p>\n<p>was taken and he was hit.         It is on these allegations that a<\/p>\n<p>crime has been registered under Secs.326 and 308 of the IPC.<\/p>\n<p>      2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent.         The petitioner has been<\/p>\n<p>continuing in custody from 30\/10\/07. There is no grievous hurt<\/p>\n<p>suffered by the de facto complainant at all.            The allegation<\/p>\n<p>under Sec.308 of the IPC has been raised with transparent<\/p>\n<p>mala fides.   There are no circumstances at all which suggest<\/p>\n<p><span class=\"hidden_text\"> B.A. NO. 7133 of 2007          -: 2 :-<\/span><\/p>\n<p>that an offence under Sec.308 of the IPC has been committed. In<\/p>\n<p>these circumstances, the petitioner may be granted regular bail<\/p>\n<p>now he having remained in custody from 30\/10\/07 and the<\/p>\n<p>incident having taken place on 23\/10\/07.<\/p>\n<p>      3.   The learned Public Prosecutor does not oppose the<\/p>\n<p>application.   The learned Public Prosecutor submits that the<\/p>\n<p>material presently available does not clinchingly indicate that<\/p>\n<p>the victim has suffered any grievous hurt. I am satisfied that the<\/p>\n<p>petitioner can now be granted regular bail subject to appropriate<\/p>\n<p>terms and conditions.\n<\/p>\n<p>      4. In the result:\n<\/p>\n<p>      (a) The application is allowed.\n<\/p>\n<p>      (b) The petitioner shall be released on bail on the following<\/p>\n<p>terms and conditions:\n<\/p>\n<p>      (i) The petitioner shall execute a bond for Rs.50,000\/- with<\/p>\n<p>two solvent sureties each for the like sum to the satisfaction of<\/p>\n<p>the learned Magistrate.\n<\/p>\n<p>      (ii) The petitioner shall make himself available          for<\/p>\n<p>interrogation before the Investigating Officer on all Mondays and<\/p>\n<p><span class=\"hidden_text\"> B.A. NO. 7133 of 2007        -: 3 :-<\/span><\/p>\n<p>Fridays between 10 a.m. and 12 noon for a period of two months<\/p>\n<p>and thereafter as and when directed by the Investigating<\/p>\n<p>Officer in writing to do so.\n<\/p>\n<\/p>\n<p>                                       (R.
