No.1785 of 2010\n                                  AVINASH CHANDRA\n                                           Versus\n                                 THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>03.   28.01.2011          Apropos    the order dated 04.01.2011, passed in the<\/p>\n<p>                   present proceeding, office has put up fresh objection on the<\/p>\n<p>                   ground that in the appellate court order it has not been stated<\/p>\n<p>                   anywhere that the period undergone shall be set off.<\/p>\n<p>                        Learned counsel for the petitioner, with reference to the<\/p>\n<p>                   provision contained in section 428 of the Code of Criminal<\/p>\n<p>                   Procedure, submits that such set off is bound to be granted in<\/p>\n<p>                   terms of the said provision.\n<\/p>\n<p>                            In that view of the matter, the defect pointed out by<\/p>\n<p>                   the office is ignored for the time being.<\/p>\n<p>                                         ( Kishore K.
