M. SAHAI)<\/p>\n<p>1.\tBy<br \/>\nway of this petition, the petitioners have prayed for the following<br \/>\nreliefs;\n<\/p>\n<p>&#8220;(a)\tdeclaring<br \/>\nthe Rules framed by the Government of Gujarat vide Government<br \/>\nResolution dated 14.09.1967, Annexure &#8216;D&#8217; hereto, ultra vires<br \/>\nArticles 14 &amp; 16 of the Constitution and null and void;\n<\/p>\n<p>(b)\tdirecting<br \/>\nthe respondent-authorities to treat the petitioners as exempted from<br \/>\npassing the GDCA examination on their attaining the age of 45 years<br \/>\nand to extend to them all consequential benefits like regularization<br \/>\nin their present grade, viz. 425-800 (pre-revised) seniority,<br \/>\npromotion, etc.<\/p>\n<p>(c)\tdirecting<br \/>\nthe respondent-authorities to treat the petitioners as promoted to<br \/>\nthe higher posts with effect from the dates when they became eligible<br \/>\nto be considered for promotion to the higher posts on the basis that<br \/>\nthey had exempted on their attaining the age of 45 years from passing<br \/>\nthe GDCA examination and extend all consequential benefits like<br \/>\ndeemed date of promotion, deemed date of seniority, arrears of<br \/>\nsalary, etc.<\/p>\n<p>(d)\trestraining<br \/>\nthe respondent-authorities from reverting the petitioners from their<br \/>\npresent posts, viz. in the grade of Rs.425-800 (pre-revised).&#8221;\n<\/p>\n<p>(e)\t&#8230;&#8230;.\n<\/p>\n<p>2.\tThe<br \/>\nissue involved in this petition is squarely covered by a decision of<br \/>\nthis Court passed in L.P.A. No.2025 of 2004 dated 08.08.2005 and<br \/>\nL.P.A. No.1131 of 2005. Learned counsel for the petitioners submitted<br \/>\nthat in view of the decisions rendered in the above matters, benefits<br \/>\ngiven to the petitioners pursuant to the interim order of this Court,<br \/>\nmay not be recovered and pension may be re-fixed on the basis of the<br \/>\nreverted post.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties. We have gone through the<br \/>\ndecisions relied upon by learned counsel Mr. S.N. Mehta for the<br \/>\npetitioners.\n<\/p>\n<p>4.\tIn<br \/>\nthe<br \/>\nresult,<br \/>\nthe petition is allowed in terms<br \/>\nof order dated 08.08.2005 passed in Letters Patent<br \/>\nAppeal No.2025\/2004 with the direction that the detailed reasons<br \/>\nrecorded in that order shall be read as part of this order. However,<br \/>\nit is clarified that if the petitioners are found entitled to<br \/>\nfixation of pay on the post of Senior<br \/>\nClerk or equivalent post,<br \/>\nin terms of Resolutions<br \/>\ndated 05.07.1991 and 16.08.1994, then such benefit should be extended<br \/>\nto them notwithstanding the fact<br \/>\nthat Special Civil<br \/>\nApplication<br \/>\nfiled by them against<br \/>\nthe reversion have been dismissed. The petitioners may represent<br \/>\nto the competent authority for<br \/>\ngrant of benefit<br \/>\nin terms<br \/>\nof Government Resolutions dated 05.07.1991 and 16.08.1994 and also<br \/>\nfor grant of consequential<br \/>\nretiral benefits. It is hoped that  any<br \/>\nsuch representation<br \/>\nmade by any of the petitioners would receive appropriate<br \/>\nattention at the hands of the competent authority<br \/>\nand decided within a maximum period<br \/>\nof three months.\n<\/p>\n<p>5.\tWith<br \/>\nthe above observations, the petition stands disposed of.
