PUBLIC PROSECUTOR for\nOpponent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 21\/02\/2011\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tappellant has preferred the present appeal under Section 374 of the<br \/>\n\tCode of Criminal Procedure, 1973 against the Judgment and Order of<br \/>\n\tconviction dated 19th December 2008 passed by the learned<br \/>\n\tAdditional Sessions Judge and Special Judge, Kheda at Nadiad, in<br \/>\n\tSpecial Case (GEB) No.34 of 2007, by which the learned trial Judge<br \/>\n\twas pleased to convict the present appellant under Section 135(1)(A)<br \/>\n\tof the Electricity Act, 2003 and ordered to undergo rigorous<br \/>\n\timprisonment for a period of two years and also imposed fine of<br \/>\n\tRs.3,27,000\/-, and in default of payment of fine, ordered to undergo<br \/>\n\tsimple imprisonment for a further period of six months.\n<\/p>\n<p>Heard<br \/>\n\tMr.C.B. Dastoor, learned counsel for the appellant and Mr.R.C.<br \/>\n\tKodekar, learned Additional Public Prosecutor for the<br \/>\n\trespondent-State.\n<\/p>\n<p>Mr.Dastoor<br \/>\n\thas contended that the appellant has expired on 15th June<br \/>\n\t2009 and places on record Death Certificate of the<br \/>\n\tappellant-Thakorbhai Ishwarbhai Patel.\n<\/p>\n<p>I<br \/>\n\thave perused the papers as well as submission advanced by<br \/>\n\tMr.Dastoor. On perusal of the papers, it appears that the appellant<br \/>\n\thas expired on 15th June 2009. Hence, in view of death of<br \/>\n\tthe the appellant, present appeal stands disposed of as abated.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
