SANKARAN, J.\n                    ---------------------------\n                     B.A. No.5439 of 2009\n                ------------------------------------\n           Dated this the 25th day of September, 2009\n\n                            O R D E R\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. Petitioners are accused Nos. 1 to<\/p>\n<p>2 in O.R. No. 22\/2009 of the Forest Range, Kasaragod.<\/p>\n<p>        2. The offence alleged against the petitioners is under<\/p>\n<p>Section 27(1)(e)(iii) and (iv) of the Kerala Forest Act.<\/p>\n<p>        3. The prosecution case is that on 7\/8\/2009, the forest<\/p>\n<p>officials got reliable information that some persons have<\/p>\n<p>entered into the forest area for cutting trees. The forest officials<\/p>\n<p>waited for about an hour in the forest area. After about one<\/p>\n<p>hour, the first accused came with a bag in his hand. On<\/p>\n<p>inspection, 4 Kgms of sandal wood pieces were found inside the<\/p>\n<p>bag. A motor bike was also found nearby. The allegation is that<\/p>\n<p>accused Nos.1 and 2 had cut 8 sandal wood trees from the<\/p>\n<p>reserve forest.\n<\/p>\n<p>        4. The petitioners were arrested on 7\/8\/2009 and they<\/p>\n<p>are in judicial custody since then. The learned Public Prosecutor<\/p>\n<p>B.A. No.5439\/ 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>submitted that the investigation is at the final stage.<\/p>\n<p>        5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioners.\n<\/p>\n<p>        6. The petitioners shall be released on bail on their<\/p>\n<p>executing a bond for Rs. 50,000\/- each with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the Chief Judicial<\/p>\n<p>Magistrate, Kasaragod subject to the following conditions:-<\/p>\n<blockquote><p>              A)   The petitioners shall report before the<br \/>\n                  Investigating Officer between 9 A.M. and<br \/>\n                  11 A.M. on all Mondays and Thursdays, till<br \/>\n                  the final report is filed or until further<br \/>\n                  orders.\n<\/p><\/blockquote>\n<blockquote><p>              B)   The petitioners shall   appear before the<br \/>\n                  Investigating Officer for interrogation as<br \/>\n                  and when required.\n<\/p><\/blockquote>\n<blockquote><p>              C)   The petitioners shall not try to influence<br \/>\n                  the prosecution witnesses or tamper with<br \/>\n                  the evidence.\n<\/p><\/blockquote>\n<blockquote><p>              D)   The petitioners shall not commit any<br \/>\n                  offence or indulge in any prejudicial<br \/>\n                  activity while on bail.\n<\/p><\/blockquote>\n<p>B.A. No.5439\/ 2009<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>              E)  In case of breach of any of the conditions<br \/>\n                  mentioned above, the bail shall be liable<br \/>\n                  to be cancelled.\n<\/p>\n<p>        The Bail Application is allowed as above.<\/p>\n<p>                                    K.T.
