DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/03\/2011 \n\n \n\nORAL ORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\nState.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel for the applicant submits that charge-sheet is filed and<br \/>\nother two co-accused have already been enlarged on bail by this<br \/>\nCourt. It is further submitted<br \/>\nthat the applicant has roots in the society, will not flee from<br \/>\njustice and will cooperate with the investigation as and when called<br \/>\nfor. It is further submitted that in view of the above, the applicant<br \/>\nmay be enlarged on bail.\n<\/p>\n<p>3.\tHeard<br \/>\nLearned APP for the respondent &#8211; State.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment,<br \/>\nprescribed for the alleged offences coupled<br \/>\nwith the fact that  charge sheet is filed,<br \/>\nwithout discussing the evidence in detail, at this stage, I am<br \/>\ninclined to enlarge the applicant on bail in connection with CR<br \/>\nNo.I-70 of 2010<br \/>\nwith Kheda<br \/>\nTown Police Station<br \/>\nfor the offences punishable under sections 392 and 114 of the Indian<br \/>\nPenal Code and Section 25(1)(A) of the Arms Act, on furnishing a bond<br \/>\nof Rs.10,000\/- (Rupees Ten Thousand only) with one surety of the like<br \/>\namount to the satisfaction of the lower Court and on conditions that<br \/>\nthe applicant shall :\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned Police Station on every 1st<br \/>\nand 15th day of English Calender month between 11.00 am<br \/>\nand 2 pm.<\/p>\n<p>[e]\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe address of residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately;\n<\/p>\n<p>5.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>6.\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>7.\tRule<br \/>\nmade absolute.
