Justice R.BASANT\n\n Dated :10\/10\/2007\n\n O R D E R\n                               R.BASANT, J\n                       ------------------------------------\n                      Crl.M.C.No.3125 of 2007\n                       -------------------------------------\n              Dated this the 10th day of October, 2007\n\n                                 O R D E R\n<\/pre>\n<p>      The petitioner faces indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under Section 308 I.P.C. The petitioner was<\/p>\n<p>earlier enlarged on bail. Investigation is now complete. Final report<\/p>\n<p>has already been filed. The case has been committed to the Court of<\/p>\n<p>Session. Assistant Sessions Court, Irinjalakuda is seized of the matter.<\/p>\n<p>Consequent to non appearance of the petitioner, a non bailable<\/p>\n<p>warrant has been issued against the petitioner by the learned<\/p>\n<p>Assistant Sessions Judge.\n<\/p>\n<p>      2.    According to the petitioner, he is innocent. His absence<\/p>\n<p>earlier was not wilful. He is willing to surrender before the learned<\/p>\n<p>Assistant Sessions Judge. But he apprehends that his application for<\/p>\n<p>regular bail may not be considered by the learned Judge on merits in<\/p>\n<p>accordance with law and expeditiously.               It is therefore prayed that<\/p>\n<p>directions under Section 482 Cr.P.C may be issued in favour of the<\/p>\n<p>petitioner.\n<\/p>\n<p>      3.    It is for the petitioner to appear before the learned<\/p>\n<p>Assistant Sessions Judge and explain to the learned Judge the<\/p>\n<p>circumstances under which he could not earlier appear before the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3125 of 2007            2<\/span><\/p>\n<p>learned Judge. I have no reason to assume that the learned Judge<\/p>\n<p>would not consider such application on merits, in accordance with law<\/p>\n<p>and expeditiously.  Every court must do the same.          No special or<\/p>\n<p>specific direction appears to be necessary.           Sufficient general<\/p>\n<p>directions have already been issued in <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1) KLT 339].\n<\/p>\n<p>      4.
