PARIKSHAN MAHTO @ BINOD MAHTO @ BHULLI MAHTO\n                SON OF SUKAN MAHTO\n                                            Versus\n                                 THE STATE OF BIHAR\n                                       ----\n<\/pre>\n<p>2.   17.6.2010             Heard learned counsel for the petitioners and the<\/p>\n<p>                 State.\n<\/p>\n<p>                           The petitioners seek bail in a case instituted for the<\/p>\n<p>                 offence under sections 144, 448, 427 and 379 of the Indian<\/p>\n<p>                 Penal Code.\n<\/p>\n<p>                           It has been submitted that the petitioners are close<\/p>\n<p>                 agnates of the informant and there is land dispute between the<\/p>\n<p>                 parties and during investigation the allegation of theft was found<\/p>\n<p>                 to be false.\n<\/p>\n<p>                           In view of such, let the petitioners, named above, who<\/p>\n<p>                 are in custody since 8.5.2010 and 13.5.2010 respectively and<\/p>\n<p>                 have no criminal antecedents, be released on bail on furnishing<\/p>\n<p>                 bail bonds of Rs. 5,000\/- (five thousand) each with two sureties<\/p>\n<p>                 of the like amount each to the satisfaction of Addl. Chief Judicial<\/p>\n<p>                 Magistrate, Jhanjharpur in Khutauna P.S.case No.32 of 2010,<\/p>\n<p>                 subject to the conditions (i) that one of the bailors will be a close<\/p>\n<p>                 relative of the petitioners, who will give an affidavit giving<\/p>\n<p>                 genealogy as to how he is related with the petitioners The<\/p>\n<p>                 bailors will undertake to furnish information to the court about<\/p>\n<p>                 any change in the address of the petitioners, (ii) that the<\/p>\n<p>                 affidavit shall clearly state that the petitioners are not an<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>            accused in any other case and if they are, they shall not be<\/p>\n<p>            released on bail, (iii) that the bailor shall also state on affidavit<\/p>\n<p>            that he will inform the court concerned if the petitioners are<\/p>\n<p>            implicated in any other case of similar nature after their release<\/p>\n<p>            in the present case and thereafter the court below will be at<\/p>\n<p>            liberty to initiate the proceeding for cancellation of bail on the<\/p>\n<p>            ground of misuse and (iv) that the petitioners will give an<\/p>\n<p>            undertaking that they will receive the police papers on the given<\/p>\n<p>            date and be present on the date fixed for charge and if they fail<\/p>\n<p>            to do so on two given dates and delays the trial in any manner,<\/p>\n<p>            their bail will be liable to be cancelled for reasons of misuse.<\/p>\n<pre>Narendra\/                         ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Jeetan Mahto &amp;Amp; Anr vs The State Of Bihar on 17 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
