JUSTICE DINESH MAHESHWARI\n\n\nNone present for the appellants\n\n\n      Nobody is present for the appellants.\n\n      Against the judgment and decree dated 13.01.2006 as\n\npassed by the Additional District Judge (Fast Track) No.2,\n\nJodhpur in Civil Suit No.165\/2004 whereby the pattas granted\n\nby the Urban Improvement Trust, Jodhpur in favour of the\n\nappellants-defendants Nos.4 &amp; 5 have been treated ab initio\n\nvoid and the appellants have been restrained by perpetual\n\ninjunction from raising any construction      on the place in\n\nquestion and not to create obstruction in use of the questioned\n\ncemented road and public chowk, this appeal was filed on\n\n28.04.2006. The office reported that the file carried 9 defects.\n\nSome of the defects having not been removed, the matter was\n\nultimately placed before the Court on 12.08.2008 but nobody\n\nappeared for the appellants and the matter was passed over;\n\nagain on 18.08.2008, nobody appeared for the appellants and\n\nthe matter was again passed over.\n\n      The matter was thereafter taken up on 21.08.2008 and\n\nagain nobody appeared for the appellant yet, in the interest of\n                                 2\n\njustice, two weeks' time was granted with the stipulation that if\n\n\n\nrequirements were not carried out, the appeal be listed for\n\nrejection before the Court.\n\n      The matter was thereafter placed before the Court on\n\n14.10.2008 and the same was passed over and then, it did not\n\nreach on 17.10.2008. The matter has, thereafter, been taken\n\nup for consideration today only.\n\n      Nobody has chosen for the appellants yet and defects\n\nhave not been removed.
