APP (SJ) No.917 of 2010\n                           RANJEET KUMAR MISHRA\n                                  Versus\n                              STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>3   19.11.2010                Bail prayer of the appellant heard after receipt of<\/p>\n<p>                  lower court records.\n<\/p>\n<p>                              The appellant stands convicted under Sections 376,<\/p>\n<p>                  323, 342 and 307 IPC.\n<\/p>\n<p>                              The allegation and evidence is that the appellant along<\/p>\n<p>                  with two others who are not the appellant here, captured the victim<\/p>\n<p>                  lady while she had gone to take water from a tube-well and that<\/p>\n<p>                  after capture, they forcibly took her into a maize field and all the<\/p>\n<p>                  three forcibly committed rape on her and that on her protest, she<\/p>\n<p>                  was badly assaulted and even tried to be killed and that the<\/p>\n<p>                  medical evidence also indicated the injury.<\/p>\n<p>                              In the facts and circumstances of the case, I do not feel<\/p>\n<p>                  inclined to enlarge the petitioner on bail. The prayer for bail is,<\/p>\n<p>                  accordingly, rejected.\n<\/p>\n<\/p>\n<pre>         Jay\/                              (C. M .
