Justice S.S.SATHEESACHANDRAN\n\n Dated :09\/06\/2009\n\n O R D E R\n                   S.S.SATHEESACHANDRAN, J.\n                   -----------------------------------\n                   W.P.(C).No.36151 of 2008 - D\n                    ---------------------------------\n                Dated this the 9th day of June, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>      This writ petition is filed under Article 227 of the<\/p>\n<p>Constitution of India seeking the following relief:<\/p>\n<blockquote><p>              &#8220;To issue a writ of certiorari or other appropriate<\/p>\n<p>        writ, order or direction calling for the records leading to<\/p>\n<p>        Ext.P2 and quash the same as illegal.&#8221;<\/p><\/blockquote>\n<p>      2.   Petitioner is the plaintiff in O.S.No.57\/2009 on the file<\/p>\n<p>of the Munsiff Court, Pathanamthitta.              Suit was one for<\/p>\n<p>injunction. Along with the plaint, petitioner filed an application<\/p>\n<p>for interim injunction to restrain the 4th defendant from<\/p>\n<p>tresspassing upon the plaint schedule property and interfering<\/p>\n<p>with his possession and enjoyment over the same.               Learned<\/p>\n<p>Munsiff after hearing both sides, concluded that the petitioner has<\/p>\n<p>not made out a prima facie case for the relief sought for and<\/p>\n<p>dismissed that application.      Ext.P1 is the copy of that order.<\/p>\n<p>Against Ext.P1 order, petitioner preferred an appeal before the<\/p>\n<p>District Court, Pathanamthitta. The appeal, after being heard,<\/p>\n<p>was disposed under Ext.P2 judgment by which the order of the<\/p>\n<p>W.P.(C).No.36151 of 2008 &#8211; D<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>dismissal of the interlocutory application by the learned Munsiff<\/p>\n<p>was upheld. Impeaching the propriety and correctness of Ext.P1<\/p>\n<p>order and Ext.P2 judgment, petitioner has filed this writ petition.<\/p>\n<p>      3.    Learned Government Pleader has taken notice for<\/p>\n<p>respondents 1 to 3. I heard the counsel for the petitioner and<\/p>\n<p>the learned Government Pleader.\n<\/p>\n<p>      4.    Having regard to the submissions made and the facts<\/p>\n<p>and circumstances presented, I find that there is no scope for<\/p>\n<p>interfering with Ext.P1 order of the learned Munsiff or Ext.P2<\/p>\n<p>judgment of the learned District Judge, which have been passed<\/p>\n<p>by the respective courts considering the merit of an interlocutory<\/p>\n<p>application moved by the petitioner in a suit. Whatever be the<\/p>\n<p>merits of the case of the petitioner for an injunction claimed in<\/p>\n<p>the suit, he can prosecute such claim tendering materials in<\/p>\n<p>support thereof.     For the time being, both the courts have<\/p>\n<p>decided only that petitioner is not entitled to the discretionary<\/p>\n<p>relief of interim injunction on the facts and circumstances<\/p>\n<p>presented and materials produced.
