This Court on 29.09.2011 had<br \/>\npassed the following order:\n<\/p>\n<p>\tMs.Thakkar,<br \/>\n\tlearned AGP, under the instructions of Mr.H.N. Shah, Executive<br \/>\n\tEngineer, states that the amount in question, without prejudice to<br \/>\n\tthe rights and contentions of the State in Civil Application No.9906<br \/>\n\tof 2011 in LPA (St.) No.1273 of 2011 shall be deposited with this<br \/>\n\tCourt on or before 19th October, 2011.\n<\/p>\n<p>\tS. O. to<br \/>\n\t20.10.2011.\n<\/p>\n<p>\tThereafter,<br \/>\non 20.10.2011 it was stated that the amount was deposited but the<br \/>\nLetters Patent Appeal was on board yesterday and, therefore, a<br \/>\nrequest was made to keep the matter today.\n<\/p>\n<p>\tToday,<br \/>\nwhen the matter is taken up, learned<br \/>\nA.G.P. states, under instructions of Mr.Sanjay<br \/>\nGarasiya, Assistant Engineer, that the Letters Patent Appeal has been<br \/>\ndismissed by the Division Bench of this Court. Under the<br \/>\ncircumstances, we find that the amount of Rs.1,50,294\/- should be<br \/>\npermitted to be withdrawn by the applicant. Hence, we ordered<br \/>\naccordingly.\n<\/p>\n<p>\tLearned<br \/>\nA.G.P. submits that let this Court may permit<br \/>\nwithdrawal subject to the orders, if any, that may be passed by the<br \/>\nhigher forum.
