Justice M.N.KRISHNAN\n\n Dated :04\/12\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n            CRL.M.C.No. 3857,3858 &amp;3859\n                         OF 2009\n            ===========================\n\n    Dated this the 4th     day of December,2009\n\n                        ORDER\n<\/pre>\n<p>    Petitioner   is   the  second   accused  in   Crime<\/p>\n<p>No.476\/2008, 527\/2007 and 926\/2008 of Thiruvalla Police<\/p>\n<p>Station  registered  for  the  offence  under  sections<\/p>\n<p>457,461 and 380 read with section 34 of Indian Penal<\/p>\n<p>Code.  By Annexure A1 orders in respective petitions,<\/p>\n<p>petitioner was granted bail on conditions.        These<\/p>\n<p>petitions are filed under sections 482 and 439(1)(b) of<\/p>\n<p>Code  of  Criminal   Procedure  to  quash   modify  the<\/p>\n<p>conditions.  Learned Magistrate directed the petitioner<\/p>\n<p>to execute a bond for Rs.1,00,000\/- with two solvent<\/p>\n<p>sureties each for the like sum providing that the<\/p>\n<p>sureties shall be residents of State of Kerala and the<\/p>\n<p>sureties  shall  produce  solvency   certificate.  This<\/p>\n<p>condition is sought to be lifted or modified.<\/p>\n<p>    2.   Learned counsel appearing for the petitioner<\/p>\n<p>and the learned Public Prosecutor were heard.<\/p>\n<p>    3.   Learned counsel submitted that when petitioner<\/p>\n<p>is a resident of Rajasthan, it is not possible for the<\/p>\n<p>petitioner  to  arrange   a  surety  from   Kerala  and<\/p>\n<p>Crl.M.C.3857,3858 &amp; 3859 of 2009    2<\/p>\n<p>therefore a condition that surety shall be from Kerala<\/p>\n<p>would tantamount to denial of bail.           Learned counsel also<\/p>\n<p>argued that when the direction is to produce              solvency<\/p>\n<p>certificate, it is a too onerous condition           as petitioner<\/p>\n<p>cannot produce sureties with solvency certificate.          It is<\/p>\n<p>also    argued    that    the   direction  to  execute a  bond  of<\/p>\n<p>Rs.1,00,000\/-      is    also   too  excessive.   Learned  counsel<\/p>\n<p>relied on the decision of this court in <a href=\"\/doc\/1269283\/\">Valson v. State of<\/p>\n<p>Kerala<\/a> (1984 KLT 443) and argued that the conditions are<\/p>\n<p>illegal and they are either to be quashed or modified.<\/p>\n<p>      4.       Learned      Public  Prosecutor  pointed  out  that<\/p>\n<p>petitioner is a resident of Rajasthan and subsequently he<\/p>\n<p>shifted to Maharashtra and was involved in twenty one cases<\/p>\n<p>in Karnataka State and three cases at Thiruvalla and two<\/p>\n<p>cases    at   Kottayam      and  in  such  circumstances,  learned<\/p>\n<p>Magistrate     imposed      the  said  conditions to  procure  the<\/p>\n<p>presence of the petitioner for the purpose of investigation<\/p>\n<p>and trial and if petitioner is to be released without the<\/p>\n<p>said conditions, he will not be available for investigation<\/p>\n<p>or trial.       It is also pointed out that three other co-<\/p>\n<p>accused are yet to be arrested.\n<\/p>\n<p>      5.    Though ordinarily while granting bail imposing a<\/p>\n<p>condition that sureties shall produce solvency certificate<\/p>\n<p>is uncalled for, in exceptional cases, it is justifiable.<\/p>\n<pre>\n\nThis is one such exceptional case.          Petitioner is a native\n\nCrl.M.C.3857,3858 &amp; 3859 of 2009    3\n\nof Rajasthan.        He was subsequently shifted to Maharashtra\n\n<\/pre>\n<p>which according to learned counsel is for the purpose of<\/p>\n<p>his   business.          Prosecution   case   is that   petitioner<\/p>\n<p>committed offences not only in Kerala but in Karnataka<\/p>\n<p>State also.       It is pointed out that twenty one cases are<\/p>\n<p>registered      in Karnataka State.      Learned counsel submitted<\/p>\n<p>that in all those cases petitioner was released on bail.<\/p>\n<p>Petitioner     is   involved     in  three  cases investigated  by<\/p>\n<p>Thiruvalla      Police     and  two   cases  by  Kottayam  Police.<\/p>\n<p>Petitioner was granted bail without such conditions by the<\/p>\n<p>Magistrate in respect of the cases pending before the<\/p>\n<p>Kottayam Police.           If the petitioner is to be released<\/p>\n<p>without sufficient conditions, for securing          his presence<\/p>\n<p>for the purpose of investigation and trial            apprehension<\/p>\n<p>expressed by the learned Public Prosecutor that he will not<\/p>\n<p>be available for investigation          appears to be genuine. It<\/p>\n<p>is more      so   when    the   three  co-accused are  yet  to  be<\/p>\n<p>apprehended. In such circumstances, the direction of the<\/p>\n<p>learned Magistrate to produce solvency certificate by the<\/p>\n<p>sureties is justifiable.\n<\/p>\n<p>      6.    When petitioner is not a native of Kerala insist<\/p>\n<p>for a surety, with solvency certificate, from Kerala may<\/p>\n<p>tantamount to denial of bail.           In such circumstance, the<\/p>\n<p>said condition could be modified.<\/p>\n<pre>\n\n      Petitions are       disposed directing  Judicial First Class\n\nCrl.M.C.3857,3858 &amp; 3859 of 2009    4\n\nMagistrate,       Thiruvalla     to  release  the  petitioner   on\n\n<\/pre>\n<p>executing a bond for Rs.1,00,000\/- (Rupees One lakh only)<\/p>\n<p>with    two    solvent     sureties  for  the  like  sum  to   the<\/p>\n<p>satisfaction of the Magistrate.         It is made clear that the<\/p>\n<p>sureties      shall    produce    solvency  certificates.   Though<\/p>\n<p>sureties     need   not     necessarily be  from  Kerala,  learned<\/p>\n<p>Magistrate      must    assure    that the   solvency  certificate<\/p>\n<p>produced are genuine.           It is also made clear that the<\/p>\n<p>sureties could be common in all the cases and separate<\/p>\n<p>sureties need not be insisted in each case.         Though learned<\/p>\n<p>counsel      sought      to    modify  the   condition   directing<\/p>\n<p>petitioner to appear before the Investigating Officer twice<\/p>\n<p>in a week, I do not find that the said condition         is to be<\/p>\n<p>insisted for permanently.           That condition would operate<\/p>\n<p>only for three months from the date of his release            and<\/p>\n<p>thereafter        petitioner     need  appear only   as and   when<\/p>\n<p>required by the Investigating Officer.
