Justice P.N.RAVINDRAN\n\n Dated :26\/03\/2009\n\n O R D E R\n                          P.N.RAVINDRAN, J.\n                 -----------------------------\n                    W.P(C) No.9819 of 2009 -V\n                ------------------------------\n              Dated this the 26th day of March, 2009.\n\n                           J U D G M E N T\n<\/pre>\n<p>      Heard Sri.M.Balagovindan, the learned Counsel appearing for<\/p>\n<p>the petitioner and Sri.A.J.Varghese, the learned Government Pleader<\/p>\n<p>appearing for respondents.\n<\/p>\n<p>      2.   The petitioner is presently working as Physical Education<\/p>\n<p>Teacher.   He was advised for appointment by the Kerala Public<\/p>\n<p>Service Commission, on 22.10.1999 and appointed by Ext.P2<\/p>\n<p>Government order dated 7.1.2002. According to the petitioner he<\/p>\n<p>possesses the qualifications prescribed for the post of HSA (English)<\/p>\n<p>also. Claiming promotion as HSA (English), he moved the Deputy<\/p>\n<p>Director of Education in Ext.P5 representation. The said request<\/p>\n<p>was rejected by Ext.P6 letter dated 22.1.2009. In this writ petition<\/p>\n<p>the petitioner challenges Ext.P6 and seeks a writ in the nature of<\/p>\n<p>mandamus commanding the Director of Public Instruction to<\/p>\n<p>appoint him as HSA (English).\n<\/p>\n<p>      3.   The petitioner&#8217;s request for appointment as HSA<\/p>\n<p>(English) was rejected by the Deputy Director of Education. The<\/p>\n<p>petitioner has straight away moved this Court challenging Ext.P6<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.9819 of 2009 -V          2<\/span><\/p>\n<p>without moving the higher authorities namely the Director of Public<\/p>\n<p>Instruction and the Government. In my opinion the petitioner ought<\/p>\n<p>to have moved the Director of Public Instruction or the Government<\/p>\n<p>seeking their intervention. I am therefore not inclined to entertain<\/p>\n<p>this writ petition at this stage. I accordingly dispose of this writ<\/p>\n<p>petition with the following directions.\n<\/p>\n<p>      The petitioner shall within one month from today file<\/p>\n<p>appropriate representation before the Secretary to Government,<\/p>\n<p>General Education Department setting out his claims and<\/p>\n<p>contentions.    The Secretary to Government, General Education<\/p>\n<p>Department shall within three months thereafter consider the said<\/p>\n<p>representation and take a decision thereon in the light of the<\/p>\n<p>relevant rules and the Government orders governing the field.
