Mehta, learned advocate for the applicants.\n<\/p>\n<p>\tPresent<br \/>\napplication has been filed seeking condonation of delay of 1460 days<br \/>\n(approximately)in filing the appeal against the order dated<br \/>\n5.5.2005.passed by the Railway Claims Tribunal, Ahmedabad Bench, in<br \/>\nC.A. no. O.A. 0200007. The applicants has made a prayer in following<br \/>\nterms:-\n<\/p>\n<p>\t Be<br \/>\npleased to pass appropriate order condoning delay of 4 \tyears \t  in<br \/>\nthe interest of justice.\n<\/p>\n<p>\tIn<br \/>\nresponse to the order dated 15.4.2010,the concerned officer of the<br \/>\nopponent-Union of India has remained present with the file\/ papers<br \/>\npertaining the aforesaid claim case decided by the Railway Claims<br \/>\nTribunal.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>B.I. Mehta, learned advocate has appeared for the opponent-Union of<br \/>\nIndia. He has produced the files\/papers  brought by the officer of<br \/>\nthe opponent-Union Of India for perusal of the Court.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>B.I. Mehta, learned advocate for the opponent-Union of India, has<br \/>\nshown the papers\/files pertaining to the aforesaid claim case filed<br \/>\nby Bhagiben widow of Bhalabhai Gandabhai and Virsing Gulab Vasava. It<br \/>\nhas been submitted that the same person has filed the claims<br \/>\npetitions in connection with the same person alleged to be the victim<br \/>\nof accident which allegedly had taken place while the victim was<br \/>\naboard.\n<\/p>\n<p>\tHaving<br \/>\nregard to the averments made in the application and submissions made<br \/>\nby Mr. P.J. Mehta learned advocate for the applicants with regard to<br \/>\nthe relief prayed for in the application, seeking condonation of<br \/>\ndelay, Rule returnable on 10th of May<br \/>\n2010.\n<\/p>\n<p>\tIf<br \/>\nthe opponent-Union of India intends to oppose the application for<br \/>\ncondonation of delay and  desires to file affidavit, opposing the<br \/>\napplication, such affidavit shall be filed on or before 5th<br \/>\nof May 2010, with a copy to the applicant&#8217;s advocate.\n<\/p>\n<p>\tLearned<br \/>\nAdvocate Mr. B.I.
