Justice K.HEMA\n\n Dated :14\/11\/2008\n\n O R D E R\n                            K.HEMA, J.\n                 ---------------------------------------------\n                        B.A.No.6656 of 2008\n                 ---------------------------------------------\n               Dated this the 14th November, 2008\n\n\n                               O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.\n<\/p>\n<p>     2.    The alleged offences are under Sections 323, 324 and<\/p>\n<p>326 read with Section 34 IPC.                  According to prosecution,<\/p>\n<p>accused nos. 1 to 3, in furtherance of common intention,<\/p>\n<p>assaulted the defacto complainant using stick and he lost a tooth.<\/p>\n<p>The incident occurred on 18.9.2008.\n<\/p>\n<p>     3.    Learned counsel for petitioners submitted that<\/p>\n<p>defacto complainant was enmical towards petitioners&#8217; family. He<\/p>\n<p>is their neighbour. He is also engaged in illicit liquor business.<\/p>\n<p>He used to come in front of the house of petitioners and under<\/p>\n<p>intoxication, abuse inmates of the house.                    He also used to<\/p>\n<p>undress himself and despite warnings, he continued these<\/p>\n<p>activities. Hence, a complaint was given to the police on<\/p>\n<p>13.7.2008.    On enquiry by police, it was found that the<\/p>\n<p>allegations  are   correct       and      hence,       defacto  complainant<\/p>\n<p>undertook before the police that he would not repeat such acts<\/p>\n<p>and he also signed in the station, it is submitted.                  But, on<\/p>\n<p>19.9.2008, he again came in front of the house and undressed<\/p>\n<p><span class=\"hidden_text\">BA No. 6656\/2008                 2<\/span><\/p>\n<p>himself and immediately, information was passed on to the police<\/p>\n<p>station stating all these facts. The third petitioner, who is the<\/p>\n<p>mother of the first accused, filed a complaint before the Sub<\/p>\n<p>Inspector, copy of which is Annexure A, in which the earlier<\/p>\n<p>complaint and settlement are referred to. The defacto<\/p>\n<p>complainant, as usual, came in front of the house and created<\/p>\n<p>problems and he was sent away and in the course of the same, a<\/p>\n<p>scuffle occurred and he fell down and lost his teeth, it is<\/p>\n<p>submitted. Petitioners are prepared to abide by any condition<\/p>\n<p>and anticipatory bail may be granted, it is submitted.<\/p>\n<p>      4.    Learned public prosecutor submitted that third<\/p>\n<p>petitioner is is not an accused in this case and hence, police has<\/p>\n<p>no intention to arrest her in connection with this crime. This<\/p>\n<p>submission is recorded. As far as the first and the second<\/p>\n<p>accused are concerned, they had assaulted the defacto<\/p>\n<p>complainant by using wooden stick, as the case diary reveals.<\/p>\n<p>Both of them had used the wooden sticks and the defacto<\/p>\n<p>complainant sustained contusion on the head and abrasion on<\/p>\n<p>the back and he also lost a tooth. In the nature of allegations<\/p>\n<p>made, it is not a fit case to grant anticipatory bail, it is<\/p>\n<p>submitted.\n<\/p>\n<p><span class=\"hidden_text\">BA No. 6656\/2008                  3<\/span><\/p>\n<p>     5.     On hearing both sides, It is clear from Annexure A<\/p>\n<p>that the parties had approached the Sub Inspector with their<\/p>\n<p>grievance earlier and the defacto complainant had acted in an<\/p>\n<p>objectionable manner in front of their house. He had agreed not<\/p>\n<p>to create any problem also. But, thereafter, the nuisance was<\/p>\n<p>repeated despite the undertaking made by him before the police.<\/p>\n<p>Whether petitioners only made efforts to prevent a nuisance or<\/p>\n<p>not is a matter which can be established at the time of evidence.<\/p>\n<p>Considering the rival contentions, I find that anticipatory bail<\/p>\n<p>can be granted to the petitioners on conditions:<\/p>\n<blockquote><p>     Hence, the following order is passed:\n<\/p><\/blockquote>\n<blockquote><p>       (1) Petitioners 1 and 2 (A1 and A2) shall surrender before<\/p>\n<p>            the Investigating Officer within seven days from today<\/p>\n<p>            and in case of arrest, they shall be released on bail on<\/p>\n<p>            their executing bond for Rs.25,000\/- each with two<\/p>\n<p>            solvent sureties each for like sum to the satisfaction<\/p>\n<p>            of the arresting officer on the following conditions:<\/p>\n<\/blockquote>\n<blockquote><p>            (i)  Petitioners shall co-operate with investigation<\/p>\n<p>                 and make themselves available for interrogation.<\/p>\n<\/blockquote>\n<blockquote><p>            (ii) Petitioners shall report before the Investigating<\/p>\n<p>                 Officer as and when directed.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">BA No. 6656\/2008                  4<\/span><\/p>\n<\/blockquote>\n<blockquote><p>            (iii) Petitioners shall not intimidate any witness or<\/p>\n<p>                  commit any offence while on bail.\n<\/p><\/blockquote>\n<blockquote><p>     (2)    The prayer for anticipatory bail by third petitioner is<\/p>\n<p>            rejected since she is not an accused.\n<\/p><\/blockquote>\n<blockquote><p>    The petition is partly allowed.<\/p><\/blockquote>\n<p>                                                K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vijayan vs State Of Kerala on 14 November, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6656 of 2008(V) 1.
