(1) 755  1990 SCC  (1)\t 68\n JT 1989 (4)   380\t  1989 SCALE  (2)1029\n\n\nACT:\n    Employees' Provident Funds and Miscellaneous  Provisions\nAct,  1952: Section 7A--Determination of amounts payable  by\nemployer as contribution--Statutory authority--Whether\tduty\nbound  to  summon evidence when requested by  party,  before\ncoming to proper conclusion.\n\n\n\nHEADNOTE:\n    Respondent No. 1--the Provident Fund Commissioner called\nupon  the  appellant--Food Corporation of India\t to  deposit\ncontribution  payable by it under the  Employees'  Provident\nFund  and Miscellaneous Provisions Act, 1952 and the  scheme\nthereunder,  in respect of workers employed by the  contrac-\ntors  appointed\t by the appellant for handling\tstoring\t and\ntransporting food grains and other articles in its depots in\nRajasthan.  On appellant's non-compliance, Respondent No.  1\nmade  an order under Section 7A of the Act  determining\t the\namount\tpayable\t by  the appellant.  Against  the  aforesaid\norder,\tthe  appellant filed writ petition before  the\tHigh\nCourt,\twhich dismissed the same. Hence the appeal, by\tspe-\ncial leave, by the appellant--Corporation.\n    It was contended that the appellant was denied a reason-\nable  opportunity to produce actual proof of  identification\nof  workers  in\t respect of whom  contribution\twas  payable\ninasmuch as Respondent No. 1 neither gave notice to contrac-\ntors, who were in possession of the relevant lists of  work-\ners,  nor made them parties to the proceedings, despite\t its\nrepeated requests.\nAllowing the appeal,\n    HELD:  The\tCommissioner, while  conducting\t an  inquiry\nunder  Section 7A of the Employees, Provident Fund and\tMis-\ncellaneous  Provisions Act, 1952 has the same powers as\t are\nvested\tin  a court under the Code of  Civil  Procedure\t for\ntrying\ta  suit.  Thus, the Commissioner  is  authorised  to\nenforce attendance in person and also to examine any  person\non  oath. He has the power requiring the discovery and\tpro-\nduction\t of documents. This power was given to\tthe  Commis-\nsioner to decide not abstract questions of law, but only  to\ndetermine actual concrete differences in payment of  contri-\nbution and other dues by identifying the\n756\nworkmen.The  Commissioner should exercise all his powers  to\ncollect all evidence and collate all material before  coming\nto proper conclusion. That is the legal duty of the  Commis-\nsioner.\t It  would be failure to exercise  the\tjurisdiction\nparticularly  when a party to the proceedings  requests\t for\nsummoning  evidence from a particular person.  [757H;  758A;\nF-H]\n    In the instant case, the appellant--Corporation had some\nproblems  in collating the lists of all workers\t engaged  in\ndepots\tscattered  at  different places.  It  requested\t the\nrespondent--Commissioner  to summon the contractors to\tpro-\nduce the respective lists of workers engaged by them. Howev-\ner, the appellant--Commissioner did not summon the  contrac-\ntors,  nor  the\t lists maintained by them.  The\t matter\t is,\ntherefore, remitted to the Commissioner for fresh  disposal.\n[757F; 759A]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>    CIVIL  APPELLATE JURISDICTION: Civil Appeal No. 4552  of<br \/>\n1989.\n<\/p>\n<p>    From  the  Judgment and Order dated 23.12. 1988  of\t the<br \/>\nRajasthan High Court in C.W.P. Mohan  for\t the<br \/>\nRespondents.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\nK. JAGANNATHA SHETTY, J. Special leave granted.<br \/>\n    Having  heard counsel on both sides and  having  perused<br \/>\nthe  material on record, we are of opinion that\t the  matter<br \/>\nrequires reconsideration by the Provident Fund Commissioner.<br \/>\n    The\t Food  Corporation of India has\t depots\t located  at<br \/>\nvarious places in Rajasthan for handling storing and  trans-<br \/>\nporting\t food  grains and other articles. It  has  appointed<br \/>\ncontractors for execution of such works and the\t contractors<br \/>\nin  turn engaged some workers. In respect of  such  workers,<br \/>\nthe Provident Fund Commissioner called upon the\t Corporation<br \/>\nto deposit contribution payable under the Employees,  Provi-<br \/>\ndent  Fund Act and the scheme framed thereunder. When  there<br \/>\nwas  non-compliance,  the Commissioner made an\torder  under<br \/>\nsection 7A of the said Act determining amount payable by the<br \/>\nCorporation.  Being  aggrieved by  that\t determination,\t the<br \/>\nCorporation moved the<br \/>\n<span class=\"hidden_text\">757<\/span><br \/>\nHigh  Court for relief under Art. 226 of  the  Constitution.<br \/>\nThe High Court has dismissed the petition. Hence the  Corpo-<br \/>\nration has appealed to this Court.\n<\/p>\n<p>    The\t grievance complained of by the Corporation is\tthat<br \/>\nit was denied of reasonable opportunity to produce  material<br \/>\nin proof of identification of the workers in respect of whom<br \/>\nthe contribution was payable. It is urged that the  contrac-<br \/>\ntors are in possession of the relevant lists and the Commis-<br \/>\nsioner\thas  not even given notice to contractors  nor\tmade<br \/>\nthem  parties  to the proceedings in spite of  repeated\t re-<br \/>\nquests\tmade  by the Corporation. Counsel for the  Union  of<br \/>\nWorkmen, however, contended that under the provisions of the<br \/>\nContract  Labour  (Regulation and Abolition) Act,  1970\t the<br \/>\nCorporation  being  the principal employer has\tto  maintain<br \/>\nlist  of  workers; that it has failed to produce  such\tlist<br \/>\nand,  therefore, it cannot throw the burden on the  contrac-<br \/>\ntors to prove the case.\n<\/p>\n<p>    We\thave carefully perused the Commissioner&#8217;s order\t and<br \/>\nalso  the order of the High Court. The total amount  ordered<br \/>\nto be payable comes to about Rs.22,48,000 in respect of\t the<br \/>\nemployees  of depots namely: Udaipur, Jaipur, Ajmer,  Badmer<br \/>\nand  Sawai Madhopur. The Commissioner has also directed\t the<br \/>\nDivisional  Officer,  Jaipur to deposit the  Provident\tFund<br \/>\nContribution i.e. Rs. 18,72,194 to the Fund being maintained<br \/>\nby  the trustees of the establishment. It is indeed a  large<br \/>\namount\tfor the determination of which the Commissioner\t has<br \/>\nonly  depended\tupon  the lists furnished  by  the  workers,<br \/>\nUnion. It is no doubt true that the employer and contractors<br \/>\nare  both  liable to maintain registers in  respect  of\t the<br \/>\nworkers\t employed.  But the Corporation seems to  have\tsome<br \/>\nproblems  in collating the lists of all workers\t engaged  in<br \/>\ndepots\tscattered at different places. It has requested\t the<br \/>\nCommissioner  to summon the contractors to produce  the\t re-<br \/>\nspective lists of workers engaged by them. The\tCommissioner<br \/>\ndid  not summon the Contractors nor the lists maintained  by<br \/>\nthem.  He  has\tstated that the Corporation  has  failed  to<br \/>\nproduce the evidence.\n<\/p>\n<p>    The\t question,  in our opinion, is not whether  one\t has<br \/>\nfailed\tto  produce evidence. The question  is\twhether\t the<br \/>\nCommissioner  who is the statutory authority  has  exercised<br \/>\npowers vested in him to collect the relevant evidence before<br \/>\ndetermining the amount payable under the said Act.<br \/>\n    It\tis of importance to remember that  the\tCommissioner<br \/>\nwhile conducting an inquiry under section (7A) has the\tsame<br \/>\npowers as are<br \/>\n<span class=\"hidden_text\">758<\/span><br \/>\nvested\tin  a Court under the Code of  Civil  Procedure\t for<br \/>\ntrying a suit. The section reads as follows:\n<\/p>\n<blockquote><p>\t      &#8220;S.  7(A)\t Determination of  Moneys  due\tfrom<br \/>\n\t      Employer&#8211;\n<\/p><\/blockquote>\n<blockquote><p>\t      (1)  The Central Provident Fund  Commissioner,<br \/>\n\t      any  Deputy  Provident  Commissioner  or\t any<br \/>\n\t      Regional\tProvident Fund Commissioner may,  by<br \/>\n\t      order  determine the amount due from  any\t em-<br \/>\n\t      ployer  under any provision of this  Act\t(the<br \/>\n\t      scheme  or  the Family Pension Scheme  or\t the<br \/>\n\t      Insurance\t Scheme as the case may be) and\t for<br \/>\n\t      this  purpose may conduct such inquiry  as  he<br \/>\n\t      may deem necessary.\n<\/p><\/blockquote>\n<blockquote><p>\t      (2)  The Officer conducting the inquiry  under<br \/>\n\t      sub-section  (1)\tshall, for the\tpurposes  of<br \/>\n\t      such  inquiry,  have the same  powers  as\t are<br \/>\n\t      vested  in  a Court under the  Code  of  Civil<br \/>\n\t      Procedure, 1908, for trying a suit in  respect<br \/>\n\t      of the following matters, namely:\n<\/p><\/blockquote>\n<blockquote><p>\t      (a) enforcing the attendance of any person  or<br \/>\n\t      examining him on oath;\n<\/p><\/blockquote>\n<blockquote><p>\t      (b) requiring the discovery and production  of<br \/>\n\t      documents;\n<\/p><\/blockquote>\n<blockquote><p>\t      (c) receiving evidence on affidavit;\n<\/p><\/blockquote>\n<blockquote><p>\t      (d) issuing commissions for the examination of<br \/>\n\t      witnesses.\n<\/p><\/blockquote>\n<p>and  any such inquiry shall be deemed to be a judicial\tpro-<br \/>\nceeding within the meaning of Sections 193 and 228, and\t for<br \/>\nthe purpose of Section 196 of the Indian Penal Code.&#8221;\n<\/p>\n<p>    It\twill  be  seen from the above  provisions  that\t the<br \/>\nCommissioner is authorised to &#8216;enforce attendance in  person<br \/>\nand  also  to examine any person on oath. He has  the  power<br \/>\nrequiring  the discovery and production of  documents.\tThis<br \/>\npower  was given to the Commissioner to decide not  abstract<br \/>\nquestions  of  law, but only to\t determine  actual  concrete<br \/>\ndifferences  in\t payment of contribution and other  dues  by<br \/>\nidentifying  the workmen. The Commissioner  should  exercise<br \/>\nall  his  powers  to collect all evidence  and\tcollate\t all<br \/>\nmaterial  before  coming to proper conclusion. That  is\t the<br \/>\nlegal  duty  of\t the Commissioner. It would  be\t failure  to<br \/>\nexercise  the jurisdiction particularly when a party to\t the<br \/>\nproceedings requests for summoning evidence from a  particu-<br \/>\nlar person.\n<\/p>\n<p><span class=\"hidden_text\">759<\/span><\/p>\n<p>    We, therefore, allow the appeal and reverse the order of<br \/>\nthe  Commissioner  and that of the High\t Court.\t The  matter<br \/>\nstands remitted to the Commissioner to dispose it of  afresh<br \/>\nand in accordance with law and in the light of the  observa-<br \/>\ntion made.\n<\/p>\n<p>    The\t parties  shall appear before  the  Commissioner  to<br \/>\nreceive further orders on December 12, 1989.
