Heard learned counsel for the petitioner and<\/p>\n<p>                   the counsel for the State.\n<\/p>\n<p>                           2. Petitioner is the widow of late Dinesh<\/p>\n<p>                   Kumar Ram who served as a PDS dealer and while<\/p>\n<p>                   the PDS license of her husband was subsisting he left<\/p>\n<p>                   for heavenly abode. Petitioner thereafter applied for<\/p>\n<p>                   grant of PDS license in her name on compassionate<\/p>\n<p>                   ground in the light of the instructions of the State<\/p>\n<p>                   Government contained in different circular(s) which<\/p>\n<p>                   inter alia provides for continuation of the PDS license<\/p>\n<p>                   in favour of the family members of the deceased PDS<\/p>\n<p>                   dealer. It appears appreciating the contents of such<\/p>\n<p>                   circular the Supply Inspector recommended for grant<\/p>\n<p>                   of PDS license in favour of the petitioner vide<\/p>\n<p>                   recommendation      dated    14.2.2007,   Annexure-2,<\/p>\n<p>                   perusal thereof however indicates that thereunder the<\/p>\n<p>                   Supply Inspector also stated that the PDS license of<\/p>\n<p>                   the husband of the petitioner may be continued in<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>          favour of the petitioner provided her husband served<\/p>\n<p>          as a PDS dealer for eight years. It is submitted on<\/p>\n<p>          behalf of the petitioner that there is no such<\/p>\n<p>          requirement in the circular dated 15.2.2007 or in the<\/p>\n<p>          earlier circulars.\n<\/p>\n<p>                   3. Having heard counsel for the parties, I<\/p>\n<p>          direct the Sub-divisional Officer, Samastipur who is<\/p>\n<p>          the licensing authority to consider the case of the<\/p>\n<p>          petitioner for grant of PDS license in lieu of the<\/p>\n<p>          license of her husband in the light of the contents of<\/p>\n<p>          the circular dated 15.2.2007 or any other relevant<\/p>\n<p>          circular issued thereafter, as early as possible, in any<\/p>\n<p>          case   within    two     months    from     the    date   of<\/p>\n<p>          receipt\/production of a copy of this order.<\/p>\n<p>                   4.
