PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This appeal  by special leave arises from the judgement<br \/>\nof the\tDivision bench\tof the Rajasthan High Court, made on<br \/>\nNovember 15,1983 in special appeal no. 18\/81. The respondent<br \/>\nhad purchased  the property  from Bhadaarmal on May 17,1958.<br \/>\nSubsequenly, the  vender was  declared insolvent. Therefore,<br \/>\nwhen the  proceeding were  sought to  be taken in respect of<br \/>\nthose properties,  the appellant  filed\t an  application  to<br \/>\ndeclare the  transfer of  the lands  made in  favour of\t the<br \/>\nrespondent under Section 53 of the Provincial Insolvency Act<br \/>\nto be  a fraudulent  one. All  the courts  have concurrently<br \/>\nfound, as a fact, that the sale transaction under Ex-A1 is a<br \/>\nbona fide  sale for  valuable consideration executed in good<br \/>\nfaith and,  therefore, the  sale was not executed to defraud<br \/>\nthe creditors.\n<\/p>\n<p>     Shri B.D.\tSharma, learned\t counsel for  the appellant,<br \/>\ncontends that  the respondent  is no other than a practicing<br \/>\nadvocate. He  having obtained  the sale\t deed, could not get<br \/>\nphysical possession  of\t the  property.\t Had  be  taken\t the<br \/>\nphysical possession,  the things  would have been different.<br \/>\nIn an  appeal filed by the insolvent himself, the High Court<br \/>\nhad stayed  delivery of the possession subject to payment of<br \/>\nrent. The finding that the possession was taken, thereby, is<br \/>\nvitiated by error of law. These facts have not been properly<br \/>\nconsidered by  the courts below in reaching that conclusion.<br \/>\nWe find no force in the contention.\n<\/p>\n<p>     Admittedly, Ex.  A-1, sale-deed  makes a  clear recital<br \/>\nthat the  possession of\t the property  sold  thereunder\t was<br \/>\ndelivered to the vendee-respondent. The learned single judge<br \/>\nof the\tHigh Court  after  elaborate  consideration  of\t the<br \/>\nevidence recorded thus:\n<\/p>\n<blockquote><p>     &#8220;There is\trecital in the sale-deed<br \/>\n     (Ex. A1) that the possession of the<br \/>\n     apartments which were in possession<br \/>\n     of\t the   transferor,   have   been<br \/>\n     delivered to  the transferor,  have<br \/>\n     been delivered  to the  transferee.<br \/>\n     Relying on\t the testimony\tof D.W.1<br \/>\n     Yugalnarain,  which   supports  the<br \/>\n     recital made  in the sale deed (Ex.<br \/>\n     A1), I  hold that the possession as<br \/>\n     mentioned in  the sale-deed (Ex.A1)<br \/>\n     in pursuance of it was delivered to<br \/>\n     the transferees. The inference that<br \/>\n     can  safely   be  drawn   from  the<br \/>\n     evidence and  broad facts\temerging<br \/>\n     therefrom\tis   that  the\tofficial<br \/>\n     receiver  has   not  succeeded   in<br \/>\n     establishing want\tof good faith on<br \/>\n     the part of respondent No.1. As the<br \/>\n     Official  Receiver\t has  failed  to<br \/>\n     discharge the  burden which  lay on<br \/>\n     him,  I   agree  with  the\t learned<br \/>\n     district judge  when the found that<br \/>\n     issue No.1\t has not been proved. it<br \/>\n     cannot be\tsaid that  the sale-deed<br \/>\n     (Ex.A1)  was   not\t  for\tvaluable<br \/>\n     consideration and\tin good faith, I<br \/>\n     hold that\tthe Official Receiver is<br \/>\n     not entitled to avoid the voluntary<br \/>\n     transfer of  sale made by Bhadarmal<br \/>\n     in favour of Yugalnarain. The sale,<br \/>\n     evidenced by Ex.A1, is not voidable<br \/>\n     against the  official Receiver  and<br \/>\n     it cannot be annulled.&#8221;<\/p><\/blockquote>\n<p>     This is  a finding\t based on  appreciation of  evidence<br \/>\nrecorded by  the learned  single judge.\t The Division Bench,<br \/>\ntherefore, was\tright in  its conclusion  that &#8220;there  is  a<br \/>\nconcurrent finding  of fact that the impugned transaction is<br \/>\na real\tone and\t with consideration&#8221;.  The trial  court held<br \/>\nthat the  sale was  made for  valuable consideration  and in<br \/>\ngood faith.  This finding  was upheld  by the learned single<br \/>\nJudge. In  this view,  it being\t a finding  of fact based on<br \/>\nappreciation of\t evidence, we  do not  find any\t substantial<br \/>\nquestion   of\t law   of   public   importance\t  warranting<br \/>\ninterference. Even  the contention  raised  by\tthe  learned<br \/>\ncounsel was in a fact considered by the learned single judge<br \/>\nand also the trial court. The direction to the vender to pay<br \/>\nrent would  be in recognition of the title of the respondent<br \/>\nas landlord  and vender\t as tenant  in occupation.  Though a<br \/>\ndifferent conclusion could be reached, but that would not be<br \/>\na ground for this court to interfere under article 136.\n<\/p>\n<p>     The appeal is accordingly dismissed.
