Justice C.K.ABDUL REHIM\n\n Dated :13\/09\/2010\n\n O R D E R\n                  C.K.ABDUL REHIM, J.\n\n              --------------------------------------\n               W.P.(C).No.28256 of 2010\n              --------------------------------------\n\n       Dated this the 13th day of September, 2010\n\n\n                      J U D G M E N T\n<\/pre>\n<p>                      &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>          Ext.P13 is an order issued by the 1st<\/p>\n<p>respondent under Section 47(6) of the Kerala Value<\/p>\n<p>Added Tax Act, 2003, imposing penalty to the tune of<\/p>\n<p>Rs.16,25,000\/- on the petitioner. The proceedings were<\/p>\n<p>initiated pursuant to interception of a transport, under<\/p>\n<p>Section 47(2) of the KVAT Act. Goods detained were<\/p>\n<p>released to the petitioner pursuant to Ext.P4 judgment<\/p>\n<p>of this court on the petitioner furnishing Bank<\/p>\n<p>Guarantee for the security deposit demanded.            In<\/p>\n<p>Ext.P13 the 1st respondent had ordered to adjust the<\/p>\n<p>amount of Bank Guarantee towards penalty imposed.<\/p>\n<p>Aggrieved by Ext.P13 the petitioner had already<\/p>\n<p>approached the Appellate Authority by filing Ext.P14<\/p>\n<p>appeal. It is also submitted that applications seeking<\/p>\n<p>interim stay as well as early hearing of the matter was<\/p>\n<p>W.P.(C).28256\/10-F            -2-\n<\/p>\n<p>filed along with the appeal. Grievance of the petitioner is<\/p>\n<p>that without considering pendency of the appeal the 1st<\/p>\n<p>respondent is now taking steps for realising the Bank<\/p>\n<p>Guarantee. Hence the petitioner is seeking direction for<\/p>\n<p>an early disposal of the appeal and till then to restrain<\/p>\n<p>realisation of the amounts covered under the Bank<\/p>\n<p>Guarantee.\n<\/p>\n<p>      2.    Heard, Government Pleader appearing for the<\/p>\n<p>respondents. Having considered the fact that the amount<\/p>\n<p>of penalty imposed is fully secured through Bank<\/p>\n<p>Guarantee, I am of the opinion that realisation of the<\/p>\n<p>amount can be directed to be kept in abeyance till the<\/p>\n<p>appeal is disposed of.\n<\/p>\n<p>      3.   Under the above circumstances the writ petition<\/p>\n<p>is disposed of directing the 2nd respondent to consider and<\/p>\n<p>pass orders on Ext.P14 appeal, after affording an<\/p>\n<p>opportunity of hearing to the petitioner, as early as<\/p>\n<p>possible, at any rate within a period of six weeks from the<\/p>\n<p>date of receipt of a copy of this judgment.
