Shamim Akhtar\n                                             Versus\n                                    The State Of Bihar\n                                ----------------------------------\n<\/pre>\n<p>4.   17.10.2011              The prayer for bail of the appellant Md.Shamim<\/p>\n<p>                  Akhtar has been considered on receipt of the lower court<\/p>\n<p>                  records.\n<\/p>\n<p>                                The appellant has been convicted under Section<\/p>\n<p>                  395 of the Indian Penal Code on the basis of the evidence of<\/p>\n<p>                  five identifying witnesses.\n<\/p>\n<p>                                The submission is that the witnesses, like, P.Ws.<\/p>\n<p>                  11 and 14 in their respective paragraph3 have stated that the<\/p>\n<p>                  dacoits had put on Galmochha and Turban so as to concealing<\/p>\n<p>                  their identities. The submission was that the admitted fact, as<\/p>\n<p>                  may appear from the same paragraph of P.W. 14, was that the<\/p>\n<p>                  dacoits were apprehended by the police and they were taken to<\/p>\n<p>                  the hospital where witnesses were also called and were shown<\/p>\n<p>                  faces of the dacoits. Contention, as such, was that the evidence<\/p>\n<p>                  of identification was vitiated.\n<\/p>\n<p>                                Regard being had to the submission and<\/p>\n<p>                  evidence, let the above named appellant be directed to be<\/p>\n<p>                  released during pendency of this appeal, on furnishing a bond<\/p>\n<p>                  of Rs. 10,000\/-( ten thousand) with two sureties of the like<\/p>\n<p>                  amount each to the satisfaction of the trial court, i.e., Ist<\/p>\n<p>                  Assistant Sessions Judge, Begusarai, in Sessions Trial No. 334<\/p>\n<p>                  of 1986.\n<\/p>\n<p><span class=\"hidden_text\">                             2<\/span><\/p>\n<p>                      As regards the sentence of fine, realisation<\/p>\n<p>        thereof from the present appellant shall remain stayed till<\/p>\n<p>        further orders.\n<\/p>\n<\/p>\n<pre>Kanth                                     ( Dharnidhar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
