KIRPAL\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     The nature\t of this  proceeding is\t similar to  that of<br \/>\nW.P. (Crl.)  Nos. 340-343 of 1993 &#8211; Vineet Narain &amp; Ors. Vs.<br \/>\nUnion of  India &amp;  Ors. It  was made clear at the outset and<br \/>\nreiterated from\t time to  time in  this\t proceeding  to\t the<br \/>\nRevenue\t Secretary,   Director\tof   C.B.I.  and  the  other<br \/>\nGovernment officials  that the\torders\tmade  in  W.P.(Crl.)<br \/>\nNos.340-343 of 1993 regarding the mode of functioning of all<br \/>\nthe officials  equally apply  in the present case also. This<br \/>\nis how,\t we  have  been\t assured  by  the  learned  Attorney<br \/>\nGeneral, is  the mode of functioning of all the officials in<br \/>\nthe present  case also.\t It is\tneedless to  say  that\tthis<br \/>\nmanner of functioning by them has to continue.\n<\/p>\n<p>     For ready\treference, an extract from one such order of<br \/>\nparticular significance\t is quoted  herein for emphasis. The<br \/>\norder is  dated 30-01-1996,  reported in,  1996 (2) SCC 199,<br \/>\nwherein it was said:\n<\/p>\n<blockquote><p>\t  &#8220;3.The facts and circumstances<br \/>\n     of the  present  case  do\tindicate<br \/>\n     that  it\tis  of\t utmost\t  public<br \/>\n     importance\t that\tthis  matter  is<br \/>\n     examined thoroughly  by this  Court<br \/>\n     to\t ensure\t  that\tall   government<br \/>\n     agencies, entrusted  with the  duty<br \/>\n     to discharge  their  functions  and<br \/>\n     obligations in accordance with law,<br \/>\n     do so,  bearing in\t mind constantly<br \/>\n     the concept  of equality  enshrined<br \/>\n     in the  Constitution and  the basic<br \/>\n     tenet of  rule of law: &#8220;Be you ever<br \/>\n     so high,  the law\tis  above  you.&#8221;<br \/>\n     Investigation into every accusation<br \/>\n     made against  each and every person<br \/>\n     on a reasonable basis, irrespective<br \/>\n     of the  position and status of that<br \/>\n     person,  must   be\t conducted   and<br \/>\n     completed\texpeditiously.\tThis  is<br \/>\n     imperative\t  to\tretain\t  public<br \/>\n     confidence in the impartial working<br \/>\n     of the government agencies.\n<\/p><\/blockquote>\n<blockquote><p>     4.\t  In this  proceeding we are not<br \/>\n     concerned with  the merits\t of  the<br \/>\n     accusations  or   the   individuals<br \/>\n     alleged to\t be involved,  but  only<br \/>\n     with the  performance of  the legal<br \/>\n     duty by  the government agencies to<br \/>\n     fairly,\tproperly    and\t   fully<br \/>\n     investigate   into\t   every    such<br \/>\n     accusation\t against  every\t person,<br \/>\n     and  to   take  the  logical  final<br \/>\n     action in accordance with law.\n<\/p><\/blockquote>\n<blockquote><p>     5.\t  In  case  of\tpersons\t against<br \/>\n     whom a prima facie case is made out<br \/>\n     and a  charge-sheet is filed in the<br \/>\n     competent court,  it is  that court<br \/>\n     which will then deal with that case<br \/>\n     on merits,\t in accordance with law.<br \/>\n     (Paras 3,4,5).<\/p><\/blockquote>\n<p>     In accordance  with the  directions so  given,  it\t has<br \/>\nbeen reported  to us  that chargesheets\t have been  filed by<br \/>\nthe C.B.I.  in two  cases and  the Delhi  Police in one case<br \/>\nwhich they were investigating These cases are :\n<\/p>\n<blockquote><p>     1) St Kitts&#8217; Forgery Case<br \/>\n     (Chargesheet filed by C.B.I. )\n<\/p><\/blockquote>\n<blockquote><p>     2)Lakhubhai Pathak Cheating Case.<br \/>\n     (Chargesheet filed by C.B.I.)\n<\/p><\/blockquote>\n<blockquote><p>     3)Rajendra Jain case.<\/p><\/blockquote>\n<p>     (Chargesheet filed by Delhi<br \/>\n     Police.)<br \/>\n     In view  of the  fact that\t chargesheet has  been filed<br \/>\nunder Section  173 Criminal  Procedure Code  in each  of the<br \/>\nabove three  cases in  the competent court, it is that court<br \/>\nwhich is  now to deal with the case on merits, in accordance<br \/>\nwith law.  Any direction  considered necessary\tfor  further<br \/>\ninvestigation, if  any, or  to\tproceed\t against  any  other<br \/>\nperson who  also appears  to have  committed any  offence in<br \/>\nthat transaction,  is within  the domain  of  the  concerned<br \/>\ncourt according\t to the\t procedure prescribed  by  law.\t The<br \/>\npurpose of  this proceeding is to command performance of the<br \/>\nduty under  law to  properly investigate into the accusation<br \/>\nof commission  of the crime and to file a chargesheet in the<br \/>\ncompetent court,  if a\tprima facie  case is  made out. This<br \/>\npurpose has been served in the above three cases, in respect<br \/>\nof which no further action in this proceeding is called for.\n<\/p>\n<p>     Accordingly, this\tproceeding has come to an end, in so<br \/>\nfar as it relates to the above three criminal cases. For the<br \/>\nremaining part,\t it is\tto  continue  till  the\t and  result<br \/>\nprescribed by  law is achieved. The concerned court in which<br \/>\nthe chargesheet\t has been  filed has  to proceed entirely in<br \/>\naccordance with\t law without  the slightest  impression that<br \/>\nthere is  any parallel\tproceeding in  respect of  the\tsame<br \/>\nmatter pending in this court.\n<\/p>\n<p>     We may  also observe,  that the concerned court dealing<br \/>\nwith the  above matters\t has to\t bear in  mind\tthat  utmost<br \/>\nexpedition  in\t the  trial  and  its  early  conclusion  is<br \/>\nnecessary for  the ends\t of justice  and credibility  of the<br \/>\njudicial process.  Unless prevented  by any dilatory tactics<br \/>\nof the accused, all trials of this kind involving public men<br \/>\nshould be  concluded most  expeditiously, preferably  within<br \/>\nthree months  of commencement of the trial. This is also the<br \/>\nrequirement of speedy trial read into Article 21.\n<\/p>\n<p>     A note  of caution\t may  be  appropriate.\tNo  occasion<br \/>\nshould arise  for an impression that the publicity attaching<br \/>\nto these  matters has  tended to  dilute the emphasis on the<br \/>\nessentials of  a fair  trial and  the  basic  principles  of<br \/>\njurisprudence including\t the presumption of innocence of the<br \/>\naccused unless\tfound guilty  at the  end of the trial. This<br \/>\nrequirement, undoubtedly  has to  be kept in view during the<br \/>\nentire trial. It is reiterated, that any observation made by<br \/>\nthis Court  for the  purpose of the proceedings pending here<br \/>\nhas no\tbearing on  the merits of the accusation, and is not<br \/>\nto influence  the trial\t in any manner Care must be taken to<br \/>\nensure that  the credibility  of the judicial process is not<br \/>\nundermined in any manner.\n<\/p>\n<p>     This proceeding  is  to  continue\tin  respect  of\t the<br \/>\nremaining matters only which are incomplete.\n<\/p>\n<p>     A copy  of this order be sent to the concerned court in<br \/>\neach of the above three cases.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Anukul Chandra Pradhan vs Union Of India &amp; Ors on 7 October, 1996 Bench: J.S.
