But in this case, the petitioner is facing recovery<br \/>\nproceedings and the matter was listed yesterday. Otherside Advocate<br \/>\nhad filed sick note and today it is reported that the Advocate for<br \/>\nthe opponent has filed leave note. In view of this, he submits that<br \/>\nthe matter be posted for hearing tomorrow as he is seeking urgent<br \/>\norders in the matter on merits. The Court is of the view that,<br \/>\nordinarily the petitions are not strictly governed by general<br \/>\npractice of accommodating Advocates in case of leave note at least.<br \/>\nHowever, in order to afford an opportunity to otherside, it is<br \/>\nordered to be kept on Friday i.e. 11.02.2011. It is specifically<br \/>\nobserved that if no one appears then the Court will pass appropriate<br \/>\norders.
