No. 3706 of 2007\n             ==========================\n             Dated this the 16th day of October, 2007\n\n                               O R D E R\n<\/pre>\n<p>      In this   Revision filed under Section 397 read with Sec. 401<\/p>\n<p>Cr.P.C. the petitioner who was the accused in S.T. No.506 of 2004 on<\/p>\n<p>the file of the J.F.C.M-II, Pathanamthitta challenges   the conviction<\/p>\n<p>entered and the sentence passed against          him for an offence<\/p>\n<p>punishable under Sec. 138 of the Negotiable Instruments Act, 1881<\/p>\n<p>(hereinafter referred to as &#8216;the Act&#8217;).\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner and<\/p>\n<p>the learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision Petitioner<\/p>\n<p>re-iterated the contentions in support of the Revision.    The courts<\/p>\n<p>below have concurrently held that the cheque in question was drawn<\/p>\n<p>by the petitioner in favour of the complainant on the drawee bank,<\/p>\n<p>that the cheque was validly presented to the bank, that it was<\/p>\n<p>dishonoured for reasons which fall under Section 138 of the Act, that<\/p>\n<p>the complainant made a demand for payment by a notice in time in<\/p>\n<p>accordance with clause (b) of the proviso to Section 138 of the Act<\/p>\n<p>and that the Revision Petitioner\/accused failed to make the payment<\/p>\n<p>within 15 days of receipt of the statutory notice.     Both the courts<\/p>\n<p>have considered and rejected the defence set up by the revision<\/p>\n<p>petitioner while entering the above finding. The said finding has been<\/p>\n<p>recorded on an appreciation of the oral and documentary evidence. I<\/p>\n<p>do    not find any error, illegality or impropriety in the finding so<\/p>\n<p>recorded concurrently by the courts below. The conviction was thus<\/p>\n<p>rightly entered against the petitioner.\n<\/p>\n<p>CRL. R.P. NO. 3706 of 2007<\/p>\n<p><span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>      4.    What now survives for consideration is the question as to<\/p>\n<p>whether a proper sentence has been imposed on the Revision<\/p>\n<p>Petitioner. Having regard to the facts and circumstances of the case, I<\/p>\n<p>am, however, inclined to modify the sentence imposed on the revision<\/p>\n<p>petitioner.    Accordingly, if the revision petitioner pays to the first<\/p>\n<p>respondent complainant by way of compensation under Sec. 357 (3)<\/p>\n<p>Cr.P.C. a sum of        Rs.1,75,000\/- (Rupees one lakh seventy five<\/p>\n<p>thousand only) within five months from today, then he need to<\/p>\n<p>undergo only imprisonment till the rising of the court.   If the revision<\/p>\n<p>petitioner commits default in making the payment as aforesaid, he<\/p>\n<p>shall undergo simple imprisonment for three months by way of default<\/p>\n<p>sentence.\n<\/p>\n<p>      5.     Amount, if any, paid by the revision petitioner pursuant to<\/p>\n<p>the orders, passed by the lower appellate court shall be refunded to<\/p>\n<p>the petitioner.\n<\/p>\n<p>      This Revision is disposed of confirming the conviction but<\/p>\n<p>modifying the sentence as above.\n<\/p>\n<\/p>\n<p>                                          V.
