In<\/pre>\n<p>accordance to the scheme formulated by the Corporation, petitioner<br \/>\nwas granted voluntary retirement and vide order-dated 12.4.2006, VRS<br \/>\nof the petitioner was accepted, all the monetary benefits were paid to<br \/>\nthe petitioner and has settled all his claims.\n<\/p>\n<p>        Now after a period of four years, petitioner has filed this writ<br \/>\npetition and contends that he had withdrawn the application submitted<br \/>\nfor grant of VRS and inspite of withdrawal of the application, he has<br \/>\nbeen granted retirement which is unsustainable.\n<\/p>\n<p>        Petitioner was granted VRS in the year 2006 and now after a<br \/>\nperiod of more than four years when the matter has been settled and all<br \/>\nthe benefits granted, interference by this Court is not proper. When the<br \/>\nVRS of the petitioner was accepted and he was retired in the year<br \/>\n2006, in case petitioner had any grievance in the matter he should have<br \/>\nimmediately challenged the action by approaching this Court, instead<br \/>\nhe accepted all the monetary benefits and remained quiet for four<br \/>\nyears. Now, after a period of more than four years, it is not proper to<br \/>\ninterfere in the matter and reopen the settled claim, which stood<br \/>\nconcluded by acceptance of the VRS by the respondents in the year<br \/>\n2006 and payment of all monetary dues to the petitioner.\n<\/p>\n<p>        Accordingly, finding no case for interference now after a period<br \/>\nof more than four years, in the matter of withdrawal of voluntary<br \/>\nretirement sought by the petitioner, this petition is dismissed.\n<\/p>\n<p>                                            (RAJENDRA MENON)<br \/>\n                                                 JUDGE<br \/>\nAks\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Narendra Kumar Jain vs The State Of Madhya Pradesh on 21 June, 2010 21.06.2010.
