Counsel for the parties that after passing of<br \/>\nthe impugned judgment and order, the directions contained in para. 3<br \/>\n[i] to [v] in the operative order, have been acted upon and new<br \/>\nChange Report has accordingly been allowed. It is, therefore,<br \/>\nclarified that if any party is aggrieved by the said Change Report<br \/>\nproceedings, the party shall be at liberty to file appropriate<br \/>\nproceedings against the said Change Report and as and when any such<br \/>\nfresh and de-novo proceedings are initiated by any party, the same<br \/>\nshall be decided in accordance with law and on its own merits and<br \/>\nwithout being in any way influenced by the observations made in the<br \/>\norder impugned herein, including the interpretation of relevant<br \/>\nstatute and its effect thereon.\n<\/p>\n<p>[II]\t\t\tSo far as the<br \/>\ndirections contained in para. 3 [vii] of the operative order passed<br \/>\nby the Ld. District Judge in the impugned judgment and order are<br \/>\nconcerned, it is submitted by the Ld. Counsel for the parties that<br \/>\nthe Charity Commissioner has already filed a Civil Suit in view of<br \/>\nand acting under the directions contained in para. 3 [vii] of the<br \/>\nimpugned order. It is, therefore, clarified and directed that the<br \/>\nsaid Civil Suit, if initiated by the Charity Commissioner in light of<br \/>\nthe directions contained in para. 3 [vii] of the impugned order,<br \/>\nshall be withdrawn by the Charity Commissioner, reserving appropriate<br \/>\nliberty to file a fresh suit, if deem fit, by the Charity<br \/>\nCommissioner upon exercise of independent discretion in that regard<br \/>\nafter giving opportunity of being heard to both the parties by the<br \/>\nCharity Commissioner.\n<\/p>\n<p>[III]\t\tIt is also clarified<br \/>\nthat directions contained in para. 3 [vii], so far as the same relate<br \/>\nto initiation of criminal proceedings are concerned, shall operate<br \/>\nonly upon appropriate finding in that regard, after giving<br \/>\nopportunity of being heard to both the parties by the Charity<br \/>\nCommissioner and upon exercise of his independent discretion.\n<\/p>\n<p>\t\tIn view of the aforesaid<br \/>\nclarifications and observations, the Ld. Counsel for the appellant<br \/>\nMr. Thakkar submits that the appeal may be disposed of accordingly.\n<\/p>\n<p>\t\tResultantly, the appeal<br \/>\nstands disposed of accordingly, subject to the above referred<br \/>\nobservations and  clarifications.\n<\/p>\n<p>\t\tIn the result, the<br \/>\ndirection contained in para. 3 [ix] in the impugned judgment and<br \/>\norder loses its survival value.\n<\/p>\n<p>\t\tAt the request made by Mr.<br \/>\nThakkar, Ld. Counsel for the appellant, it is clarified that in case<br \/>\nof any difficulty, the parties shall be at liberty to move this<br \/>\nCourt.\n<\/p>\n<p>\t\tAs the appeal is hereby<br \/>\ndisposed of, Civil Application does not survive and it is accordingly<br \/>\ndisposed of.
