SHRI DILIP RAOSAHEB DESHMUKH, JJ             \n\n    Dated:05\/11\/2008\n\n:    Judgement\n\n\n       05.11.2008\n\n\n\n\n     This    claimant's   appeal   for   enhancement    of\ncompensation is directed against the award dated 29.9.1999\npassed  in  Motor Accident Case No.25\/99, whereby  learned \nAdditional  Motor  Accident Claims  Tribunal,  Baikuntpur,\nCamp  Court  -  Surajpur,  has  awarded  compensation   of\nRs.94,000\/-  with interest at the rate of  12%  per  annum\nfrom the date of application to the claimant for the death\nof  her  husband namely Ramjit Yadav, who died in a  motor\nvehicle  accident on 15.4.1996, involving tractor  bearing\nregistration  No.  MP  27  B\/0429,  which  was  owned   by\nrespondent No.2 and insured with respondent No.1  for  the\nrelevant period.\n\n     The   claimant   filed  a  claim  petition   claiming\ncompensation of Rs.17,00,000\/- with the averment that  she\nis  the  widow of deceased Ramjit Yadav, who was 50  years\nold at the time of accident and was earning Rs.5,000\/- per\nmonth  from  his  Provision  Shop  and  agriculture.   The\naccident  occurred on 15.4.1996 at about  16.30  hours  in\nVillage-Inderpur and the deceased died on the spot.\n     Respondent No.1\/insurance company contested the claim \npetition  on  the ground that the vehicle in question  was\nbeing  driven in breach of policy condition as the tractor\nwas  used  for other than agriculture purpose, the  driver\nwas  not  holding valid and effective driving licence  and\ntherefore,  the insurance company cannot be  saddled  with\nthe responsibility of satisfying the award.\n\n     Respondents  No.  2  to 4 also  contested  the  claim\npetition  and  took  a  stand that the  claimant  was  not\ndependent on the deceased as he had no earning of his own. \nThe accident occurred as a result of sudden failure of the\nbrake   of  tractor,  the  tractor  was  insured  by   the\nrespondent   No.1   and  therefore,   liability   to   pay\ncompensation   lies  with  the  respondent  No.1\/insurance\ncompany.  \n\n     The  applicant examined herself and her witness Bhola\n(AW-2) in support of her claim petition whereas respondent\nNo.  1  examined  its  Branch  Manager  of  Ambikapur  and\nHarishchandra.   Respondents  No.  2  &amp;  4  also  examined\nrespondent No.2 Devpal Sharan Singh-owner of the  tractor,\nand Birbal, respondent No.4-driver of the tractor.\n\n     Learned  tribunal, on close scrutiny of the  evidence\navailable on record, held that deceased Ramjit Yadav  died\nas  a  result of accident caused due to rash and negligent\ndriving  of the offending tractor by respondent No.4;  the\ntractor  was  being  driven  by  respondent  No.4;  though\nrespondent  No.  3  did  not have valid  driving  licence,\nhowever,  it has no effect as the vehicle in question  was\nbeing  driven  by  respondent No.4  and  the  tractor  was\nvalidly  insured by the respondent No.1 for  the  relevant\nperiod.\n\n     Rejecting the claim of the claimant that her  husband\nwas  earning Rs.5,000\/- per month, the tribunal held  that\nthe  deceased was earning Rs.500\/- per month from the shop \nand   his  earning  from  agriculture  could  not   exceed\nRs.20,000\/- per annum and thus, quantifying the earning of\nthe  deceased at Rs.26,000\/- per annum, deducting 50% from \nthe  above income towards the expenses, which the deceased  \nmight have been incurring on himself and further deducting\n50%  from  the  remaining Rs.13,000\/- with an  observation\nthat  the  claimant must be earning at least 50% from  the\nagricultural  land,  assessed the loss  of  dependency  at\nRs.6,500\/-  per annum.  Taking age of the deceased  as  50\nyears  and  selecting the multiplier of  13,  compensation\ntowards  loss  of dependency was assessed at  Rs.84,500\/-.\nIn addition thereto, compensation of Rs.9,500\/- on various\nother  heads  has  also been awarded to the  claimant  and\nthus,  a total compensation of Rs.94,000\/- was awarded  in\nfavour of the claimant.\n\n     Learned counsel for the appellant submits that  while\nassessing dependency of the appellant on the deceased, the \ntribunal has deducted 3\/4th of the total annual earning of\nthe  deceased, which is not permissible under the law  and\nthe  tribunal  could  not deduct  more  than  50%  towards\npersonal expenditure of the deceased.\n\n     On  the  other  hand,  Shri  Patel,  learned  counsel\nappearing  for respondent No.1\/insurance company contended  \nthat the tribunal has rightly assessed the dependency  and\nproper    compensation   has   been   awarded    to    the\nappellant\/claimant, which does not call for interference.\n\n     We  have  heard learned counsel for the  parties  and\nperused the records of the claims tribunal.\n\n     As for finding of the tribunal that the deceased died\nas  a  result of accident caused by the offending tractor,\nwhich  was  being driven by respondent No.4 Birbal  rashly\nand  negligently, as also earning of the deceased from the\nshop   at  the  rate  of  Rs.500\/-  per  month  and   from\nagriculture at the rate of Rs.20,000\/- per annum,  it  has\nattained finality as neither the respondent No.1\/insurance\ncompany nor any other respondents has preferred any appeal \nagainst the impugned award.  In fact, this finding is  not\nunder challenge before us in this appeal.\n\n     For   the   purpose  of  assessing  the  quantum   of\ncompensation,  the  tribunal has assessed  income  of  the\ndeceased  from the shop at Rs.6,000\/- per annum  and  from\nagriculture  Rs.20,000\/- per annum. However, while  making\ndeductions  towards personal expenditure of the  deceased,\nthe  tribunal has held that the deceased would  have  been\nspending   50%  on  himself.   After  making   the   above\ndeduction,  the  remaining Rs.13,000\/-  has  been  further\ndeducted   on   the  ground  that  loss  of  income   from\nagriculture  cannot  be  assessed  to  be   50%   as   the\nappellant\/claimant   must  be   earning   50%   from   her\nagricultural  holding even after death  of  the  deceased.\nThus,  in our considered opinion, the calculation made  by\nthe tribunal in this regard is erroneous. The deceased was\nearning Rs.6,000\/- p.a. from his shop, therefore, it could\nbe  safely  inferred that out of Rs.6,000\/-,  he  must  be\nspending Rs.3,000\/- on himself and hence, there is a  loss\nof  dependency  to  the  tune of Rs.3,000\/-  p.a.  to  the\nappellant\/claimant   under  this  head.   Similarly,   the\ntribunal has already recorded a finding that on account of\ndeath of Ramjit Yadav, the claimant has suffered 50%  loss\nin earning from agricultural land, therefore, the tribunal\nought to have held loss of dependency at Rs.10,000\/-  p.a.\nin agricultural income of Rs.20,000\/-.\n\n     In  this view of the matter, we assess the total loss\nof  dependency due to death of Ramjit Yadav at Rs.13,000\/-\np.a.  and applying the multiplier of 13, since age of  the\ndeceased at the time of accident was 50 years as has  been\nheld  by  the tribunal, the compensation towards  loss  of\ndependency comes to Rs.1,69,000\/-.  If we add further  sum\nof  Rs.9,500\/-,  which has been awarded  by  the  tribunal\nunder  various  other  heads, the total  compensation  for\nwhich  the appellant\/claimant is entitled, is assessed  at\nRs.1,78,500\/-.  As the appellant\/claimant has already been\nawarded  Rs.94,000\/-  by  the  claims  tribunal,  she   is\nentitled for an additional amount of Rs.84,500\/-.\n\n     Since  the appeal was pending from the year 1999  and\nthe respondent No.1\/insurance company alone cannot be held  \nresponsible for delay in deciding this appeal, we quantify\nthe  interest  on  the enhanced amount of  Rs.84,500\/-  at\nRs.8,500\/- and accordingly, modify the impugned  award  by\nenhancing the compensation of Rs.94,000\/- to Rs. 1,87,000\/-\n.\n<\/pre>\n<p>     For  the aforesaid reasons, the appeal filed  by  the<br \/>\nappellant\/claimant under Section 173 of the Motor  Vehicle<br \/>\nAct  is  allowed in part.  The compensation of Rs.94,000\/-<br \/>\nawarded by the tribunal is enhanced to Rs.1,78,500\/-  with<br \/>\nfurther quantified amount of interest of Rs.8,500\/- on the<br \/>\nenhanced amount of compensation of Rs.84,500\/-.\n<\/p>\n<p>     Respondent  No.1\/insurance  company  is  granted  two<br \/>\nmonths&#8217;  time  for  depositing  the  additional   sum   of<br \/>\nRs.93,000\/-  (Rupees  Ninety Three Thousand)  (Rs.84,500\/-<br \/>\ntowards  enhanced  amount  of  compensation  +  Rs.8,500\/-<br \/>\ntowards  interest on the enhanced amount of  compensation)<br \/>\nbefore the concerned claims tribunal.\n<\/p>\n<p>     No order as to costs.\n<\/p>\n<pre>     J U D G E                                    J U D G E\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Chattisgarh High Court Fulesri Widow Of Ramjit vs United India Insurance Company on 5 November, 2008 IN THE COURT OF CHATTISGARH AT BILASPUR M.A.No. 2363 of 1999 Fulesri Widow of Ramjit &#8230;Petitioners Versus 1.
