APPEAL NO. 19 OF 2003\n                    ----------------------------------------------\n\n                 Dated this the 24th day of September, 2007\n\n                                  JUDGMENT\n<\/pre>\n<p>       This appeal is filed against the judgment in C.C. No.48 of 2002 on<\/p>\n<p>the file of the Judicial First Class Magistrate&#8217;s Court III, Kannur.<\/p>\n<p>       2. The appellant filed the complaint before the court below alleging<\/p>\n<p>that the first respondent &#8211; accused committed offence punishable under<\/p>\n<p>Section 138 of the Negotiable Instruments Act, 1881. The court below<\/p>\n<p>took cognizance of the complaint, served notice on the accused and posted<\/p>\n<p>the case to 2.7.2002.      On 2.7.2002, finding that the complainant was<\/p>\n<p>absent, the trial court acquitted the accused under Section 256(1) Cr.P.C.<\/p>\n<p>       3. This Court heard the learned counsel appearing on either side.<\/p>\n<p>       4. Learned counsel appearing for the appellant submits that<\/p>\n<p>originally the complaint was filed before the                  Judicial First Class<\/p>\n<p>Magistrate&#8217;s Court, Payyannur and subsequently the case was made over to<\/p>\n<p><span class=\"hidden_text\">CRL.APPEAL NO.19\/2003                   2<\/span><\/p>\n<p>the Judicial First Class Magistrate&#8217;s Court III, Kannur. Learned counsel<\/p>\n<p>submits that though the transfer of the case was notified on the notice<\/p>\n<p>board, it was without notice to the counsel appearing for the appellant in<\/p>\n<p>the trial court and that the clerk of the counsel also failed to note the same.<\/p>\n<p>Counsel further submits that the posting of the case was also without<\/p>\n<p>notice to the appellant and hence, the appellant &#8211; complainant could not<\/p>\n<p>appear before the trial court.\n<\/p>\n<\/p>\n<p>       5. A reading of the impugned order would show that the learned<\/p>\n<p>trial Magistrate had not complied with the dictum laid down by this Court<\/p>\n<p>in the decisions reported in <a href=\"\/doc\/408134\/\">Don Bosco v. Partech Computers,<\/a> 2005(2)<\/p>\n<p>K.L.T. 1003 and <a href=\"\/doc\/1024152\/\">G.F.S. Chit &amp; Loans (P) Ltd. v. Rajesh,<\/a> 2006(3)<\/p>\n<p>K.L.T. 825.      In the above two judgments, this Court had categorically<\/p>\n<p>held that unmerited disposal of complaints will affect dispensation of<\/p>\n<p>justice. Further, the Apex Court in the decision reported in <a href=\"\/doc\/1219241\/\">Associated<\/p>\n<p>Cement Co. Ltd. v. Keshvanand,<\/a> 1998(1) K.L.T. 179 (SC) held that on<\/p>\n<p>order under Section 256(1) Cr.P.C.         shall be passed only under the<\/p>\n<p>following circumstances:\n<\/p>\n<\/p>\n<blockquote><p>                    &#8220;First is, if the court thinks that in a<br \/>\n             situation it is proper to adjourn the hearing then<br \/>\n             the magistrate shall not acquit the accused.<br \/>\n             Second is, when the magistrate considers that<br \/>\n             personal attendance of the complainant is not<\/p>\n<p><span class=\"hidden_text\">CRL.APPEAL NO.19\/2003                  3<\/span><\/p>\n<p>             necessary on that day the magistrate has the<br \/>\n             power to dispense with his attendance and<br \/>\n             proceed with the case.     When the court notices<br \/>\n             that the complainant is absent on a particular day<br \/>\n             the court must consider whether           personal<br \/>\n             attendance of the complainant is essential on that<br \/>\n             day for the progress of the case and also whether<br \/>\n             the situation does not justify the case being<br \/>\n             adjourned to another date        due to any other<br \/>\n             reason. If the situation does not justify the case<br \/>\n             being adjourned the court is free to dismiss the<br \/>\n             complaint and acquit the accused.       But if the<br \/>\n             presence of the complainant on that day was quite<br \/>\n             unnecessary then resorting to the step of axing<br \/>\n             down the complaint may not be a proper exercise<br \/>\n             of the power      envisaged in the section.   The<br \/>\n             discretion must therefore, be exercised judicially<br \/>\n             and fairly without impairing the cause of<br \/>\n             administration of criminal justice.&#8221;<\/p><\/blockquote>\n<p>     6. In the above circumstances, this Court is of the view that the<\/p>\n<p>order of the trial court is liable to be set aside. The impugned order is<\/p>\n<p>accordingly set aside and the matter is remanded to the trial court for fresh<\/p>\n<p>disposal as per law.\n<\/p>\n<\/p>\n<p>     The Crl. Appeal is allowed by way of remand.
