Bhatt, learned Standing Counsel appearing for the<br \/>\nRevenue.\n<\/p>\n<p>2.\t\tThe<br \/>\nRevenue has filed this Tax Appeal under Section 260A of the Income<br \/>\nTax Act, 1961 for the assessment year 1992-93 proposing to formulate<br \/>\nthe following question of law:\n<\/p>\n<p>?SWhether,<br \/>\non the facts and in the circumstances of the case, the Appellate<br \/>\nTribunal was right in law in confirming the order of the CIT (A)<br \/>\nwhereby he allowed depreciation on the factory and office building at<br \/>\nPune, despite the sale deed not having been executed in favour of the<br \/>\nassessee and the property not standing in its name and hence not<br \/>\n?Sowned?? by the assessee in terms of Section 32 of the Act, by<br \/>\ndisregarding the binding ratio of the Apex Court in the case of Tamil<br \/>\nNadu Civil Supplies Corporation Ltd. vs. CIT, 249 ITR 214 (SC)???\n<\/p>\n<p>3.\t\tAn<br \/>\nidentical question arose before this Court in assessee&#8217;s own case in<br \/>\nIncome Tax Reference No.23 of 1996 with Tax Appeal No.150 of 1999.<br \/>\nThe question posed before this Court in the said Tax Reference as<br \/>\nwell as Tax Appeal was as under:\n<\/p>\n<p>?SWhether,<br \/>\non the facts and in the circumstances of the case, the Tribunal is<br \/>\nright in holding that the assessee is entitled to grant of<br \/>\ndepreciation on factory building and office building though the<br \/>\nconveyance deed in respect of these properties was not registered in<br \/>\nfavour of the assessee till the end of the accounting year relevant<br \/>\nto the previous year under consideration???\n<\/p>\n<p>\t\tWhile<br \/>\nanswering the said question in favour of the assessee and against the<br \/>\nRevenue, this Court has held that since assessee acquired the<br \/>\npossession and was running factory on payment of substantial part of<br \/>\nprice, the assessee was entitled to grant of depreciation on the<br \/>\nfactory building though the conveyance deed in respect of these<br \/>\nproperties was not registered in favour of the assessee till the end<br \/>\nof the accounting year relevant to the previous year under<br \/>\nconsideration. While deciding the Tax Reference and the Tax Appeal in<br \/>\nfavour of the assessee, this Court has referred to decision of the<br \/>\nHon&#8217;ble Supreme Court in the case of  Mysore Minerals Limited<br \/>\nvs. CIT [1999] 239 ITR 775 (SC).\n<\/p>\n<p>4.\t\tFollowing<br \/>\nthe aforesaid decision of this Court in the assessee&#8217;s own case, we<br \/>\nare of the view that the issue is squarely covered in favour of the<br \/>\nassessee and against the Revenue. We are, therefore, not formulating<br \/>\nany question of law as no question of law is arising out of the order<br \/>\nof the Tribunal and even if such question arises, the same is<br \/>\nconcluded by the decision of this Court in the assessee&#8217;s own case.\n<\/p>\n<p>\t\tTherefore,<br \/>\nthe Tax Appeal is accordingly dismissed.\n<\/p>\n<p>[K.A.\n<\/p>\n<p>Puj, J.]<\/p>\n<p>[Bankim<br \/>\nN.
