Kuriakose, J.\n<\/p>\n<\/p>\n<p>     Challenge in this OP filed under Article 227 by the<\/p>\n<p>tenant is against Ext.P4 order. Under Ext.P4 the learned<\/p>\n<p>Rent Control Appellate Authority has granted stay of<\/p>\n<p>execution of the eviction order on condition that the entire<\/p>\n<p>arrears of rent found by the Rent Control Court is deposited<\/p>\n<p>within four weeks and the petitioners\/appellants continue to<\/p>\n<p>deposit the rent which falls due subsequently.<\/p>\n<p>     2.   Sri.V.G.Arun,     the    learned     counsel for the<\/p>\n<p>petitioners would submit that the condition imposed under<\/p>\n<p>Ext.P4 is not warranted in the present case where the<\/p>\n<p>petitioners have denied the title of the respondent\/landlord<\/p>\n<p>and the correctness of the finding of the court below to the<\/p>\n<p>O.P.(R.C) No.459 of 2011<\/p>\n<p><span class=\"hidden_text\">                             -: 2 :-<\/span><\/p>\n<p>effect that the denial is not bonafide itself is under<\/p>\n<p>challenge. According to him, by insisting that the arrears of<\/p>\n<p>rent as found by the court below should be deposited, the<\/p>\n<p>learned Appellate Authority has virtually confirmed the<\/p>\n<p>finding of the Rent Control Court.\n<\/p>\n<p>     3.    According to us, the above submission has only<\/p>\n<p>superficial attractiveness what the learned Appellate<\/p>\n<p>Authority has done is to impose a condition for favourably<\/p>\n<p>exercising its discretion in the matter of granting stay of<\/p>\n<p>execution proceedings. We do not find any case is made out<\/p>\n<p>by the petitioner for invoking the visitorial jurisdiction of<\/p>\n<p>this Court Article 227 for interfering with Ext.P4.<\/p>\n<p>           We decline jurisdiction and dismiss the OP.<\/p>\n<p>However, we make it clear that deposit of the arrears of<\/p>\n<p>rent pursuant to Ext.P4 by the petitioner will be without<\/p>\n<p>prejudice to all the contentions raised by the petitioners in<\/p>\n<p>the case including the contention that there is no landlord-<\/p>\n<p>tenant relationship between them and the respondent. We<\/p>\n<p>O.P.(R.C) No.459 of 2011<\/p>\n<p><span class=\"hidden_text\">                             -: 3 :-<\/span><\/p>\n<p>also direct the learned Appellate Authority to permit the<\/p>\n<p>landlord to withdraw the amount to be deposited pursuant<\/p>\n<p>to Ext.P4 only subject to the result of the RCA.<\/p>\n<p>           Since time fixed by the Appellate Authority has<\/p>\n<p>already expired, we extend the time for depositing the<\/p>\n<p>arrears of rent by 10 days from today.\n<\/p>\n<\/p>\n<p>                                     PIUS C.
