Sushil Kumar Yadav S\/O Rajendra Yadav R\/O Vill.-\n                   Barahkurwa, P.S.- Kumarkhand, Distt.- Madhepura.\n                                             Versus\n                                     1. The State of Bihar\n                                       --------------------\n<\/pre>\n<p>02.   19.09.2011             Heard learned counsel for the petitioner and the<\/p>\n<p>                    State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for<\/p>\n<p>                    the offences under Section 414 of the Indian Penal Code<\/p>\n<p>                    and Sections 25 (1-B) A, 26 and 35 of the Arms Act.<\/p>\n<p>                             Considering that the petitioner is in custody<\/p>\n<p>                    since 09.01.2011 for recovery of arms and the petitioner&#8217;s<\/p>\n<p>                    brother Manjesh Kumar is ready to stand surety for him,<\/p>\n<p>                    let the petitioner, above named be released on bail on<\/p>\n<p>                    furnishing bail bond of Rs. 5,000\/- (Five Thousand) with<\/p>\n<p>                    two sureties of the like amount each or any other surety<\/p>\n<p>                    as fixed by the Court to the satisfaction of Chief Judicial<\/p>\n<p>                    Magistrate, Madhepura in connection with Murliganj P.S.<\/p>\n<p>                    Case No. 07 of 2011 subject to the following conditions:-<\/p>\n<p>                    (i) That one of the bailors will be a close relative of the<\/p>\n<p>                    petitioner who will give an affidavit giving genealogy as to<\/p>\n<p>                    how he is related with the petitioner and the other bailor<\/p>\n<p>                    shall be the brother of the petitioner namely Manjesh<\/p>\n<p>                    Kumar. The bailor will also undertake to inform the Court<\/p>\n<p>                    if there is any change in the address of the petitioner. (ii)<\/p>\n<p>                    That the affidavit shall clearly state that the petitioner is<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>not an accused in any other case and if he is he shall not<\/p>\n<p>be released on bail. (iii) That the bailor shall also state on<\/p>\n<p>affidavit that he will inform the court concerned if the<\/p>\n<p>petitioner is implicated in any other case of similar nature<\/p>\n<p>after his release in the present case and thereafter the<\/p>\n<p>court below will be at liberty to initiate the proceeding for<\/p>\n<p>cancellation of bail on the ground of misuse. (iv) That the<\/p>\n<p>petitioner will give an undertaking that he will receive the<\/p>\n<p>police papers on the given date and be present on date<\/p>\n<p>fixed for charge and if he fails to do so on two given dates<\/p>\n<p>and delays the trial in any manner, his bail will be liable<\/p>\n<p>to be cancelled for reasons of misuse. (v) That the<\/p>\n<p>petitioner will be well represented on each date and if he<\/p>\n<p>fails to do so on two consecutive dates, his bail will be<\/p>\n<p>liable to be cancelled.\n<\/p>\n<p>         In the nature of allegations, the petitioner is<\/p>\n<p>directed to appear before the Head Priest of Local Temple,<\/p>\n<p>Madhepura within fifteen days of his release and file a<\/p>\n<p>certificate about the same in the Court. On filing of the<\/p>\n<p>certificate the petitioner will be granted provisional bail for<\/p>\n<p>a period of six months. In case, the petitioner does not file<\/p>\n<p>a certificate about his reporting to the Head Priest within<\/p>\n<p>two weeks of his release from jail custody, he shall be<\/p>\n<p>noticed cancellation of bail. During six months the<\/p>\n<p>petitioner is expected to engage himself in fruitful<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>           activities under the guidance of the Head Priest, Local<\/p>\n<p>           Temple, Madhepura and at the end of the six months, he<\/p>\n<p>           will file a certificate of his conduct in the court below<\/p>\n<p>           issued by the Head Priest.
