GOVERNMENT PLEADER for\nRespondent(s) : 1 - 2. \nMR AMAR D MITHANI for Respondent(s) : 3, \nMR\nDEEPAK P SANCHELA for Respondent(s) :\n3, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/02\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npetitioner has  prayed  for a direction  to quash  and set aside the<br \/>\nimpugned order dated 27th November 2006 passed by the<br \/>\nrespondent No. (1) in appeal No.  79 of 2005.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner is a handicapped person suffering  from Polio since<br \/>\nchildhood.  The petitioner has completed his graduation as Bachelor<br \/>\nof Arts in Hindi  in the year 2001 from Saurashtra University. The<br \/>\npetitioner is registered with the Employment exchange  of District<br \/>\nJunagadh.\n<\/p>\n<p>3.\t\tPursuant<br \/>\nto the advertisement appeared in Daily news Paper in February, 2005<br \/>\ninviting applications from local educated unemployed  persons  in<br \/>\ngeneral  category  for allotment  of new fair price shops  at village<br \/>\nSimasi, the petitioner made an application along with respondent No.<br \/>\n3 and other three candidates.\n<\/p>\n<p>4.\t\tAfter<br \/>\npetitioner being found eligible the respondent No. 2 issued order to<br \/>\nallot  Fair Price shop to the petitioner.\n<\/p>\n<p>5.\t\tThe<br \/>\npetitioner  was granted license  pursuant to order dated 4th<br \/>\nJune 2005 by the competent authority to run fair price shop at<br \/>\nvillage  Simsi Taluka Mendarda. The petitioner also executed<br \/>\nnecessary agreement.\n<\/p>\n<p>6.\t\tThe<br \/>\nrespondent No. 3 preferred  appeal No. 79 of 2005 before the<br \/>\nrespondent No. 1. The petitioner appeared before the respondent  No.<br \/>\n1 through his power of attorney  holder during the course of the<br \/>\nhearing  of the above appeal.  The petitioner submitted his affidavit<br \/>\n dated 24th November 2005, copy of power of Attorney<br \/>\ndated 11th August  2005 and certificate from Gram<br \/>\nPanchayat as well as representation signed by village people  that<br \/>\npetitioner is running Fair Price Shop.\n<\/p>\n<p>7.\t\tAfter<br \/>\na period of one year respondent No. 1 allowed the appeal No. 79 of<br \/>\n2005 filed by the respondent No. 3 on the ground that as the<br \/>\npetitioner is 80% physically challenged and is not capable of running<br \/>\nthe Fair Price Shop  and directed the respondent No. 2 to allot Fair<br \/>\nPrice Shop to respondent No. 3. Hence this petition.\n<\/p>\n<p>8.\t\tLearned<br \/>\nadvocate for the petitioner has contended that the  respondent No. 1<br \/>\nhas brushed aside  the recommendations of both Taluka  and District<br \/>\nlevel Committee to allot fair price shop to the petitioner who is<br \/>\nmore qualified than the respondent No. 2. It is also submitted that<br \/>\nvillage people are getting  food supply without any problem  and the<br \/>\npetitioner is only running the fair price shop  and the Gram<br \/>\nPanchayat  is satisfied  with the working of the petitioner.\n<\/p>\n<p>9.\t\tLearned<br \/>\nadvocate for the petitioner has contended that  the petitioner has<br \/>\nnot committed any breach   and without  taking into consideration<br \/>\nthis aspect the authority has wrongly arrived at a conclusion that<br \/>\nthe petitioner is not competent  to carry on the business of the fair<br \/>\nprice shop.\n<\/p>\n<p>10.\t\tAs<br \/>\na result of hearing and  perusal of the record, I am of the view<br \/>\nthat even  if there is a disability, a person can run the fair price<br \/>\nshop and on the ground of disability, he cannot  be denied  his<br \/>\nvaluable  right. Admittedly the Taluka and District level committee<br \/>\nhas recommended  the case of the petitioner.  There is a certificate<br \/>\nof Simasi  gram Panchayat and joint representation of the signatures<br \/>\nof the village people to the effect that the people of village Simasi<br \/>\nare getting regular supply  of food without any problem.  The Gram<br \/>\nPanchayat  is satisfied with the working of the petitioner.  There<br \/>\nare no allegations that the petitioner has not committed breach of<br \/>\nany of the conditions of grant of license.    I am therefore,  of the<br \/>\nview  that the case of the  petitioner cannot be disregarded merely<br \/>\non the ground that he is a handicapped person. It is also required to<br \/>\nbe noted  that as per the provisions of Persons  with Disabilities<br \/>\n(Equal Opportunities, Protection of Rights  and Full Participation)<br \/>\nAct, 1995 the petitioner is entitled to get the benefit of priority.<br \/>\nThere is nothing on record to show that the petitioner is not able to<br \/>\ncarry on  running the fair price shop  in a satisfactory manner. When<br \/>\nthere is no complaint  it would not be appropriate  for the authority<br \/>\nto disturb  the license of the petitioner. I am therefore  of the<br \/>\nview that the appellants authority has committed an error in passing<br \/>\nthe impugned order.\n<\/p>\n<p>11.\t\tIn<br \/>\nthe  premises aforesaid, the impugned order dated 27th<br \/>\nNovember 2006 passed by the respondent No. 1 in Appeal No. 79 of 2005<br \/>\nis hereby quashed and set aside.
