    Petitioner is the second accused in Crime<\/p>\n
No.226\/2006 of Medical College Police Station,<\/p>\n
Kozhikode.  The allegation is that he committed<\/p>\n
offence under section 489B read with section 34<\/p>\n
of Indian Penal Code along with other accused.<\/p>\n
As  per  order  dated  20.2.2009,   this  court<\/p>\n
granted  bail   to  the   petitioner  in   bail<\/p>\n
application 685\/2009.   One of the conditions<\/p>\n
imposed was that he shall not leave the limits<\/p>\n
of the Police Station within which the crime is<\/p>\n
registered, except with the previous permission<\/p>\n
of the Magistrate.  Crl.M.C.1641\/2009 is filed<\/p>\n
to lift the said condition.    The passport of<\/p>\n
the petitioner was seized by the police during<\/p>\n
investigation  and  was  produced   before  the<\/p>\n
learned   Magistrate.       Petitioner    filed<\/p>\n

C.M.P.1095\/2009            before    Judicial  First  Class<\/p>\n
Magistrate under section 451 of Code of Criminal<\/p>\n
Procedure to release the passport contending that<\/p>\n
he is working          in Qatar and   if he fails to report<\/p>\n
at Qatar before 30.5.2009 his visa will expire and<\/p>\n
he will loose the employment          therein and therefore<\/p>\n
the passport is to be released.              The prosecutor<\/p>\n
opposed the application contending that if the<\/p>\n
passport is released, he will leave India and there<\/p>\n
is every chance for repeating the crime.            Learned<\/p>\n
Magistrate dismissed the petition as per order<\/p>\n
dated      11.5.2009        holding  that  considering  the<\/p>\n
seriousness of the offence and the submission of<\/p>\n
the Prosecutor he is of the opinion that the<\/p>\n
passport shall not be released to the petitioner at<\/p>\n
this stage. Crl.M.C. 1633\/2009 is filed to quash<\/p>\n
that order and to grant interim custody of the<\/p>\n
passport.\n<\/p>\n
      2.         Learned      counsel  appearing  for   the<\/p>\n
petitioner and the learned Public Prosecutor were<\/p>\n

heard.\n<\/p>\n
      3.         Learned      counsel  appearing   for  the<\/p>\n
petitioner submitted that unless the passport is<\/p>\n
released the period of visa cannot be extended and<\/p>\n
he would lose his entire business and the very life<\/p>\n
and therefore in the interest of justice he is to<\/p>\n
be permitted to leave India and to be away for two<\/p>\n
months and for that limited purpose passport          is to<\/p>\n
be released.          Learned counsel also   submitted that<\/p>\n
petitioner        is      prepared  to  give  any  security<\/p>\n
including        that      of   his  close   relatives  and<\/p>\n
unconditional          undertaking  to  appear  before  the<\/p>\n
court      within       two   months  from  that  date  and<\/p>\n
therefore        his      passport  be  released   and  the<\/p>\n
condition while granting bail be lifted.<\/p>\n
      4.       Learned      Public  Prosecutor opposed  the<\/p>\n
application submitting that if petitioner leaves<\/p>\n
India, he may not return and there is every chance<\/p>\n
for     repeating         the  offence  and  therefore  the<\/p>\n
passport cannot be released.\n<\/p>\n

      5.     The order for bail granted by this court<\/p>\n
does not contain a prohibition against leaving<\/p>\n
India.         It      only  contains  the  condition  that<\/p>\n
petitioner shall not leave the limits of the Police<\/p>\n
Station,       within      which  the crime  is  registered<\/p>\n
except       with      the   previous  permission  of   the<\/p>\n
Magistrate.          Therefore petitioner is entitled to<\/p>\n
seek     permission of the Magistrate and leave India,<\/p>\n
if it is permissible.            Therefore I find no reason<\/p>\n
to lift the condition in the bail order as sought<\/p>\n
for.      With liberty to the petitioner to move the<\/p>\n
Magistrate        for     permission, Crl.M.C.1641\/2009  is<\/p>\n
disposed.\n<\/p>\n
      6.     The case of the petitioner is that the<\/p>\n
period of his visa will expire unless the passport<\/p>\n
is released and petitioner could go over to Qatar<\/p>\n
and if he fails, his entire business will be<\/p>\n
ruined.       Learned counsel submitted that petitioner<\/p>\n
is prepared to give any security or guarantee<\/p>\n
including that of his close relatives and will<\/p>\n

assure       that      he   will  appear  within  the  time<\/p>\n
stipulated by the Magistrate and therefore the<\/p>\n
passport may be released.\n<\/p>\n
      7.      In the light of this submission of the<\/p>\n
petitioner that he is prepared to seek            permission<\/p>\n
of the        Magistrate to leave India for a limited<\/p>\n
purpose and he             is prepared to give any security<\/p>\n
and guarantee for his return within two months<\/p>\n
learned Magistrate may consider the application to<\/p>\n
leave India for the short period and to release the<\/p>\n
passport for that purpose             on getting sufficient<\/p>\n
security and guarantee that he will return and<\/p>\n
appear within the stipulated time.<\/p>\n
      Petitions are disposed accordingly.<\/p>\n
