Respondents\n\n\n\n\tThe above Writ Petition was filed under Article 226 of The Constitution of\nIndia praying for the issuance of a Writ of Certiorari to call for the records\nrelating to the impugned Consent Order No.81\/2004 dated 3.3.2005 - Proceedings\nNo.DEE\/TNV\/F 1050\/O\/L\/A\/2005 dated 3.3.2005 passed by the respondents 1 &amp; 2 and\nquash the same.\n\n!For Petitioner       \t: Mr.G.R.Swaminathan\n\n^For Respondents \t: Mr.R.Raman\n1and 2\n\nFor 3rd Respondent    \t: Mr.K.Mahendran\n\nFor 4th Respondent    \t: Mr.G.Masilamani, Sr.Counsel for\n                          Mr.K.Mthuramalingam\n\nFor 5th Respondent    \t: Mr.G.Praburajdurai for\n                          Mr.V.Ramalingam\n\n\n:ORDER\n<\/pre>\n<p>(Order of the  Court was made by DHARMA RAO ELIPE, J.)<\/p>\n<p>\tThe above writ petition was filed against the  impugned Consent Order<br \/>\nNo.81\/2004 dated 3.3.2005 &#8211; Proceedings No.DEE\/TNV\/F\/1050\/L\/A\/2005 dated<br \/>\n3.3.2005 passed by the first and second respondents in favour of the fourth<br \/>\nrespondent to start an Industry, on the ground that though the fourth respondent<br \/>\nsubmitted an application dated 28.2.2005, the first respondent Board without<br \/>\nobserving the just formality of holding enquiry, in a mechanical manner ought<br \/>\nnot to have issued the Consent Order dated 3.3.2005.  Therefore, it is contended<br \/>\nby the learned counsel for the petitioner that the consent given by the first<br \/>\nrespondent was in contravention of Section 25 of the Water (Prevention and<br \/>\nControl of Pollution) Act, 1974.\n<\/p>\n<p>\t2.To test the veracity of the contention raised by the learned counsel for<br \/>\nthe petitioner, we have gone through the provisions of law applicable to the<br \/>\nabove said Act.  Section 25 of the Act contemplates the restrictions on new<br \/>\noutlets and new discharges.  Subject to the provisions of this section, no<br \/>\nperson shall, without the previous consent of the State Board,-\n<\/p>\n<p>\ta)establish or take any steps to establish any industry, operation or<br \/>\nprocess, or any treatment and disposal system or any extension or addition<br \/>\nthereto, which is likely to discharge sewage or trade effluent into a stream or<br \/>\nwell or sewer or on land; or\n<\/p>\n<p>\tb)bring into use any new or altered outlet for the discharge of sewage; or\n<\/p>\n<p>\tc)begin to make any new discharge or sewage:\n<\/p>\n<p>Further sub section 2 of Section 25 of the Act contemplates that an application<br \/>\nfor consent of the State Board under sub-section (1) shall be made in such form,<br \/>\ncontain such particulars and shall be accompanied by such fees as may be<br \/>\nprescribed.  Sub section 3 of Section 25  of the Act is relevant for the purpose<br \/>\nthat the State Board may make such inquiry as it may deem fit in respect of the<br \/>\napplication for consent referred to in sub-section (1) of Section 25 of the Act<br \/>\nand in making any such inquiry, shall follow such procedure as may be<br \/>\nprescribed.\n<\/p>\n<p>\t3.Therefore, the writ petition relying on sub section 3 of Section 25 of<br \/>\nthe Act contemplates for making such application for grant of consent of the<br \/>\nBoard in making any such inquiry as it may deem fit in respect of the<br \/>\napplication for consent referred to sub section 1 of Section 25 of the Act.  In<br \/>\nthe case on hand, the fourth respondent admittedly was already granted<br \/>\npermission to start the industry.\n<\/p>\n<p>\t4.As seen from the counter filed by the fourth respondent, the fourth<br \/>\nrespondent applied for consent for establishing the unit to produce the<br \/>\nfollowing soft drink products by utlizing the water supplied by SIPCOT.\n<\/p>\n<p>\t1.  Coco Cola\n<\/p>\n<p>\t2.  Fanta\n<\/p>\n<p>\t3.  Limca\n<\/p>\n<p>\t4.  Thums Up\n<\/p>\n<p>\t5.  Carbonated\/no carbonated\n<\/p>\n<p>\t6.  Spirte\n<\/p>\n<p>\t7.  Maza<\/p>\n<p>In the counter it is stated that the fourth respondent applied for consent to<br \/>\nestablish the soft drink manufacturing unit in the site of SIPCOT near<br \/>\nPirancheri Village of Tirunelveli District and the first respondent vide letter<br \/>\ndated 25.10.2004 asked fourth respondent to furnish certain additional<br \/>\nparticulars.  Thereafter, the fourth respondent also made a revised application<br \/>\ndated 29.10.2004 to the first respondent.  Thereafter on 21.10.2004 SIPCOT has<br \/>\nagreed to supply 600 KLD of water to the fourth respondent subject to the<br \/>\navailability.  After secrutinising and complying with all the procedures, the<br \/>\nfirst respondent issued the Consent Order to establish the unit under Section 25<br \/>\nof the Water (Prevention and Control of Pollution) act, 1974 as amended under<br \/>\nSection 21 of the Air (Prevention and Control of Pollution) Act, 1981, vide<br \/>\nproceedings dated 19.11.2004.  Therefore, the fourth respondent obtained fresh<br \/>\nallotment of water supply from SIPCOT vide letter dated 22.2.2005 and thereby<br \/>\nthe quantity of water supply was enhanced from 600 KLD to 900 KLD.  Thereafter,<br \/>\non the basis of above additional water supply, on 28.2.2005 the fourth<br \/>\nrespondent applied for consent with the revised proposal on the treatment and<br \/>\ndisposal of domestic sewage and trade effluent.  Since the original application<br \/>\ndated 14.10.2003 was considered after thorough enquiry, the first respondent<br \/>\nissued the revised consent to establish the unit for the enhanced production<br \/>\ncapacity vide proceedings dated 3.3.2005.\n<\/p>\n<p>\t5.With regard to the counter filed by the first and second respondents, it<br \/>\nis stated that as per the application submitted by the fourth respondent,<br \/>\nenquiry was already conducted on 17.2.2006 to start the Industry as per Section<br \/>\n25 of the of the Water (Prevention and Control of Pollution) Act, 1974 and that<br \/>\nthe consent was given in accordance with the conditions laid down under section<br \/>\n25 of the Act.\n<\/p>\n<p>\t6.The learned counsel for the fourth respondent in support of his<br \/>\ncontention submitted that the fourth respondent&#8217;s unit falls under the category<br \/>\nof food and beverage which was classified as orange category of Industries and<br \/>\nhence there was no necessity of public hearing under the Environmental Impact<br \/>\nAssessment Notification issued in the year 1994 by the Government of India.\n<\/p>\n<p>\t7.After hearing the counsel appearing for parties and considering the fact<br \/>\nthat as on today, the above said Industry has not started its production, we<br \/>\ncannot interfere with the utilisation of water supplied by SIPCOT.  The main<br \/>\nissue in the writ petition is with regard to the Consent Order given as per<br \/>\nSection 25 of the Act on the basis of the application dated 28.2.2005 by<br \/>\nrespondents 1 and 2 on 3.3.2005 and the objection is that the consent was given<br \/>\nwithout any proper enquiry as required under sub-section 3 of Section 25 of the<br \/>\nact.  But as stated above, the consent was given by the respondents 1 &amp; 2 on<br \/>\n3.3.2005, only after conducting enquiry  for expansion of the Industry.<br \/>\nTherefore, it is open to the Board to conduct the public hearing if they deem it<br \/>\nis necessary.  Further, we notice that as per Section 27 of the Act the refusal<br \/>\nor withdrawal of consent lies with the State board and as per Section 28 of the<br \/>\nAct, any person aggrieved by an order made by the State Board under Section 25<br \/>\nof 26 or section 27 may, within thirty days from the date on which the order is<br \/>\ncommunicated to him, prefer an appeal to the State<\/p>\n<p>Government,  But the petitioner without availing the effective alternative<br \/>\nremedy, straight away approached this Court.  Therefore, on this ground also,<br \/>\nthe writ petition is liable to be dismissed.\n<\/p>\n<p>\t8.We find no reason to interfere with the orders passed by the respondent<br \/>\nNos.1&amp;2 in the writ petition  and therefore the same is dismissed.
