Justice M.SASIDHARAN NAMBIAR\n\n Dated :18\/09\/2009\n\n O R D E R\n                M.Sasidharan Nambiar, J.\n               --------------------------\n                 Crl.M.C.No.3002 of 2009\n               --------------------------\n\n                         ORDER\n<\/pre>\n<p>     Petitioner is the accused in C.C.No.296\/2001, now<\/p>\n<p>pending as L.P.No.70\/2008, on the file of Judicial<\/p>\n<p>First  Class  Magistrate&#8217;s   Court-IV,  Kozhikode. This<\/p>\n<p>petition is filed under Section 482 of Code of Criminal<\/p>\n<p>procedure for a direction to the Magistrate to consider<\/p>\n<p>the application for bail to be moved by the petitioner<\/p>\n<p>on the date of surrender.\n<\/p>\n<p>     2.  When  an  accused  surrenders  and  files  and<\/p>\n<p>application for bail, Magistrate is expected to pass<\/p>\n<p>orders on the application without delay. I find no<\/p>\n<p>reason to believe that Magistrate is unaware of the<\/p>\n<p>provisions of law or the decisions of this Court or the<\/p>\n<p>Apex   Court  or  that  Magistrate   will  not  act  in<\/p>\n<p>accordance with law.
