He made a mention that an amicable settlement has<br \/>\nbeen arrived at between the parties, which, he desires to place on<br \/>\nrecord and that therefore, the matter may be ordered to be listed on<br \/>\nthe cause list and the paper may be called for. Accordingly, the<br \/>\nregistry was directed to list the matter in today&#8217;s cause list. As<br \/>\nper the direction, the cause list has been prepared and displayed.<br \/>\nThe petition is, accordingly, listed in today&#8217;s cause list at 2.30<br \/>\np.m. and the papers of the petition has been placed before the<br \/>\nCourt.\n<\/p>\n<p>2.\tMr.\n<\/p>\n<p>Paul, learned advocate for the petitioner, has placed a photocopy of<br \/>\nthe terms of the settlement dated 4.2.2011, which are finalized<br \/>\nbetween the parties i.e. the petitioner and the respondent workman.<br \/>\nHe has submitted that though the appearance of learned advocate for<br \/>\nthe respondent is not shown in the previous order dated 10.8.2010,<br \/>\nMr. U.T.Mishra, learned advocate, has informed him that he would be<br \/>\nappearing on behalf of the respondent workman and he is aware about<br \/>\nthe fact that the settlement between the parties has been arrived at.\n<\/p>\n<p>3.\tSince<br \/>\nby virtue of the settlement, the respondent workman has agreed to<br \/>\ngive-up his right and claim for reinstatement (as awarded by the<br \/>\nLabour Court by the impugned award), this Court has considered it<br \/>\nappropriate to call the respondent workman before the Court and<br \/>\nconfirm the factual aspects from him. Mr. Paul has informed the Court<br \/>\nthat he would intimate his client, i.e. the employer of the<br \/>\nrespondent workman, who in turn will instruct the respondent workman<br \/>\nto remain present on 25.2.2011 so that the factual aspects of the<br \/>\nsettlement can be confirmed.\n<\/p>\n<p>\tHence,<br \/>\nS.O. to 25.2.2011.
