Justice C.T.RAVIKUMAR\n\n Dated :04\/11\/2010\n\n O R D E R\n                          C.T.RAVIKUMAR, J.\n                       ----------------------------\n                       W.P.(C)No.33497 of 2010\n                       ----------------------------\n                       Dated 4th November, 2010\n\n                               JUDGMENT\n<\/pre>\n<p>            The grievance of the petitioners, who are retired<\/p>\n<p>employees of the Kerala State Electricity Board, is pertaining to the<\/p>\n<p>non-disbursement of gratuity payable to them under the Payment of<\/p>\n<p>Gratuity Act, 1972.      As per Ext.P1 series of orders, the second<\/p>\n<p>respondent found that the petitioners are entitled to get the balance<\/p>\n<p>amount of gratuity. The same was challenged by the third respondent<\/p>\n<p>before the first respondent in appeals. However, the first respondent<\/p>\n<p>dismissed the appeals, as is obvious from Ext.P2 series of orders.     At<\/p>\n<p>the time of filing of the said appeals, the Kerala State Electricity Board<\/p>\n<p>had deposited the arrears of gratuity payable to the petitioners before<\/p>\n<p>the first respondent. Despite the dismissal of the appeals, no action<\/p>\n<p>was taken by the first respondent to disburse the gratuity amount<\/p>\n<p>already deposited by the third respondent.
