Justice S.S.SATHEESACHANDRAN\n\n Dated :03\/08\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.21738 OF 2009\n           --------------------------\n      Dated this the 3rd day of August 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>        The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<\/p>\n<p>        i)   To set aside Ext.P2 order passed in<\/p>\n<p>I.A No.142\/2009 in O.S No.35\/2007 on the file of<\/p>\n<p>the Munsiff Court, Attingal.\n<\/p>\n<\/p>\n<p>        ii)      Issue  an   order  allowing  I.A<\/p>\n<p>No.142\/2009 in O.S No.35\/2007 on the file of the<\/p>\n<p>Munsiff Court, Attingal and appoint a new Advocate<\/p>\n<p>Commissioner.\n<\/p>\n<p>W.P.(C).No.21738 OF 2009     Page numbers<\/p>\n<p>          iii)     To grant such other reliefs as this<\/p>\n<p>Hon&#8217;ble    Court    may  deem   just   and  fit  in   the<\/p>\n<p>circumstances of the case.\n<\/p>\n<\/p>\n<p>          2.    Petitioners are the defendants in O.S<\/p>\n<p>No.35\/2007     on   the  file  of   the   Munsiff  Court,<\/p>\n<p>Attingal.        Suit   is  for   declaration   and   for<\/p>\n<p>injunction, and respondent is the plaintiff in the<\/p>\n<p>suit.     An advocate commissioner appointed by the<\/p>\n<p>court initially conducted a local inspection and<\/p>\n<p>filed a report.      Later, on the application moved by<\/p>\n<p>the plaintiff and defendants \/ petitioners, the<\/p>\n<p>same    commissioner     visited     the   property   and<\/p>\n<p>determined the matters sought for by both sides and<\/p>\n<p>filed a report.      Pursuant thereto    the respondent \/<\/p>\n<p>plaintiff moved an application alleging that the<\/p>\n<p>interim injunction granted by the court had been<\/p>\n<p>violated by the defendants and applied for the<\/p>\n<p>appointment      of     a  commissioner    as    to   the<\/p>\n<p>interference      and   obstruction    caused  over   the<\/p>\n<p>pathway, the subject matter involved in the suit in<\/p>\n<p>W.P.(C).No.21738 OF 2009     Page numbers<\/p>\n<p>respect    of   which   the  order   of  injunction  was<\/p>\n<p>passed.      The court below allowed the commission<\/p>\n<p>report and appointed the same commissioner to visit<\/p>\n<p>and prepare a report.      At that stage the defendants<\/p>\n<p>alleging bias against the commissioner sought for<\/p>\n<p>changing     him    by  filing    an   application.  The<\/p>\n<p>application was objected to by the plaintiff.        The<\/p>\n<p>learned Munsiff after hearing both sides dismissed<\/p>\n<p>the application vide Ext.P2 order.         Propriety and<\/p>\n<p>correctness        of that order is challenged in the<\/p>\n<p>petition     invoking   the  supervisory    jurisdiction<\/p>\n<p>vested with this court under Article 227 of the<\/p>\n<p>Constitution of India.\n<\/p>\n<\/p>\n<p>          3.     I heard the learned counsel for the<\/p>\n<p>petitioner.      Having regard to the submissions made<\/p>\n<p>and taking note of the facts and circumstances<\/p>\n<p>presented with reference to Ext.P2 order, I find no<\/p>\n<p>notice to the respondent is necessary and hence it<\/p>\n<p>is dispensed with.       Perusing Ext.P2 order, I find<\/p>\n<p>the learned Munsiff has taken note that no specific<\/p>\n<p>W.P.(C).No.21738 OF 2009      Page numbers<\/p>\n<p>allegation imputing bias or being partisan to the<\/p>\n<p>plaintiff      is    levelled   against     the   advocate<\/p>\n<p>commissioner and also that the earlier report was<\/p>\n<p>prepared and filed by him determining the points<\/p>\n<p>raised by both the defendant as well as plaintiffs<\/p>\n<p>without any objection.        The learned Munsiff found<\/p>\n<p>no merit in the allegations imputed against the<\/p>\n<p>advocate     commissioner     and    so   much   so,   the<\/p>\n<p>application moved for removal of the commissioner<\/p>\n<p>was dismissed as without merit.          After hearing the<\/p>\n<p>counsel at length, I find no reason to interfere<\/p>\n<p>with the order passed by the learned Munsiff.         The<\/p>\n<p>commission report after all is only a piece of<\/p>\n<p>evidence in a case.       Its   evidentiary value can be<\/p>\n<p>determined if objections are raised by any of the<\/p>\n<p>parties to the suit only after examination of the<\/p>\n<p>commissioner.      So much so, ample opportunity will<\/p>\n<p>be provided to the parties of the suit to raise<\/p>\n<p>whatsoever     their    objections   against   the  report<\/p>\n<p>prepared by the commissioner.           When there is no<\/p>\n<p>material to substantiate the apprehension expressed<\/p>\n<p>W.P.(C).No.21738 OF 2009     Page numbers<\/p>\n<p>by the petitioner that commissioner is partisan and<\/p>\n<p>the earlier two reports had been prepared by him in<\/p>\n<p>the case, it is only fair and just that the report<\/p>\n<p>to be prepared to determine whether there was any<\/p>\n<p>violation     of   the  order  of   injunction  also be<\/p>\n<p>determined by the same commissioner.       I do not find<\/p>\n<p>any impropriety or illegality in the order passed<\/p>\n<p>by   the   learned     Munsiff  whereby   right  of the<\/p>\n<p>petitioner to challenge the report already filed<\/p>\n<p>and also the report, which is to be filed after the<\/p>\n<p>visit   by    the   commissioner   is   deferred to for<\/p>\n<p>consideration at trial of the suit.<\/p>\n<p>          4.
