{"id":44143,"date":"2010-01-29T00:00:00","date_gmt":"2010-01-28T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shri-nand-kishore-vs-central-vigilance-commission-on-29-january-2010"},"modified":"2015-09-28T07:15:13","modified_gmt":"2015-09-28T01:45:13","slug":"shri-nand-kishore-vs-central-vigilance-commission-on-29-january-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shri-nand-kishore-vs-central-vigilance-commission-on-29-january-2010","title":{"rendered":"Shri Nand Kishore vs Central Vigilance Commission &#8230; on 29 January, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Shri Nand Kishore vs Central Vigilance Commission &#8230; on 29 January, 2010<\/div>\n<pre>                CENTRAL INFORMATION COMMISSION\n                  Complaint No. - CIC\/WB\/C\/2009\/000288 dated: 02.06.'09\n                         Right to Information Act- Section 18\n\nComplainant:        Shri Nand Kishore\nRespondent:         Central Vigilance Commission (CVC), New Delhi.<\/pre>\n<p>                                      Decision<br \/>\n                                Announced: 29.1.2010<\/p>\n<p>       The Commission has received a complaint from Shri Nand Kishore of<br \/>\nGurgaon, Haryana praying as follows:-\n<\/p>\n<blockquote><p>       &#8220;&#8230;to kindly ask Central Vigilance Commission to inform the<br \/>\n       action taken against Mr. Kanan for false report prepared by<br \/>\n       him and what basis he took into account while preparing the<br \/>\n       report.&#8221;<\/p><\/blockquote>\n<p>        That question in the form of queries regarding a report prepared by Shri<br \/>\nKanan, Director Central Vigilance Commission against the complainant which<br \/>\nwas allegedly &#8220;false and cooked report contrary to the facts against me&#8221;, was<br \/>\noriginally raised through an application of 20.12.2008. In his response of<br \/>\n06.03.2009 CPIO Shri Rohit Tiwari, Director, Central Vigilance Commission<br \/>\nexpressed his inability in providing information saying, &#8220;your queries do not<br \/>\namount to seeking information as defined under Section 2(f) of the RTI Act.&#8221; The<br \/>\ncomplainant has moved a complaint before this Commission contending that the<br \/>\nplea taken by the CPIO is &#8220;irrelevant and not covering the points\/information<br \/>\nsought and even not complying the Section 2(f) of RTI Act&#8221;. He has, however, not<br \/>\napproached the first appellate authority, Central Vigilance Commission u\/s 19(1)<br \/>\nof the Act.\n<\/p>\n<p>         Nevertheless, the complainant, on getting what he perceived as being a<br \/>\nmisleading response from the CPIO, could have preferred an appeal under u\/s<br \/>\nSection 19(1) of the Act, a recourse available with him, which has not actually<\/p>\n<p><span class=\"hidden_text\">                                           1<\/span><br \/>\n been resorted to in the present case. Because the 1st appellate authorities has<br \/>\nnot addressed the questions of complainant, which are of direct concern to his<br \/>\npublic authority and the complainant has pleaded no ground for making a direct<br \/>\ncomplaint before us, the Commission has decided to remand this complaint to<br \/>\nthe First Appellate Authority Shri Alok Bhatnagar, Additional Secretary, Central<br \/>\nVigilance Commission, New Delhi to dispose of the complaint of Shri Nand<br \/>\nKishore within ten working days from the date of receipt of this decision notice,<br \/>\ntreating it as an appeal u\/s 19(1) of the RTI Act, under intimation to Shri Pankaj<br \/>\nShreyaskar, Jt Registrar, Central Information Commission. If not satisfied with<br \/>\nthe information provided on his 1st appeal, complainant Shri Nand Kishore will be<br \/>\nfree to move a 2nd appeal before us as per Sec 19 (3).\n<\/p>\n<p>        Announced this twenty-ninth day of January 2010.
