Justice K.T.SANKARAN\n\n Dated :22\/01\/2010\n\n O R D E R\n                         K.T.SANKARAN, J.\n                   ---------------------------------------------\n                         B.A.No.278 of 2010\n                   ---------------------------------------------\n             Dated this the 22nd day of January, 2010\n\n\n                                ORDER\n<\/pre>\n<p>      This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is the accused in<\/p>\n<p>Crime No.01 of 2010 of Chengannur Excise Range.<\/p>\n<p>      2.   The offence alleged against the petitioner is under<\/p>\n<p>Section 55(i) of the Abkari Act.\n<\/p>\n<p>      3.   The prosecution case is that on 1.1.2010, the<\/p>\n<p>petitioner was found engaged in the sale of Indian made foreign<\/p>\n<p>liquor. A quantity of 750 ml. of Indian made foreign liquor was<\/p>\n<p>seized from him. The petitioner was arrested on the same date.<\/p>\n<p>He is in judicial custody since then.\n<\/p>\n<p>      4.   The learned counsel for the petitioner submitted that<\/p>\n<p>the petitioner is not involved in any other case of similar nature.<\/p>\n<p>      5.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner.\n<\/p>\n<p><span class=\"hidden_text\">BA No.278\/2010                    2<\/span><\/p>\n<p>     The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.15,000\/- with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class-I, Chengannur, subject to the following conditions:<\/p>\n<p>a)   The petitioner shall report before the investigating officer<br \/>\n     between 9 A.M. and 11 A.M. on all Mondays, till the final<br \/>\n     report is filed or until further orders;<\/p>\n<p>b)   The petitioner shall appear before the investigating officer<br \/>\n     for interrogation as and when required;<\/p>\n<p>c)   The petitioner shall not try to influence the prosecution<br \/>\n     witnesses or tamper with the evidence;<\/p>\n<p>d)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is allowed as above.<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                   JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Prabhakaran vs The State Of Kerala on 22 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 278 of 2010() 1.
