JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\ngroup of Appeals preferred under clause 15 of the Letters Patent<br \/>\narise from the common judgment and order dated 10th<br \/>\nFebruary, 2009 passed by the learned Single Judge in the above writ<br \/>\npetitions.\n<\/p>\n<p>\tSubject<br \/>\nmatter of dispute is appointment of certain Anganwadi workers at<br \/>\nvarious Anganwadi centres in the villages of Balasinor taluka,<br \/>\nDistrict Kheda.\n<\/p>\n<p>\tThe<br \/>\nChild Development Project Officer, Balasinor published advertisement<br \/>\ndated 12th May, 2008 to invite applications for selection<br \/>\nand appointment of Anganwadi workers at various Anganwadi centres in<br \/>\nthe villages of Balasinor taluka. Pursuant to the said advertisement,<br \/>\nthe appellants and others had applied for selection and appointment<br \/>\nas Anganwadi workers. It was the respondent no.4 in each Appeal who<br \/>\nwas selected and appointed as Anganwadi worker. The appellants having<br \/>\nnot been selected, preferred the above writ petitions under Article<br \/>\n226 of the Constitution of India. It was the case of the appellants<br \/>\nthat the appointment of Anganwadi workers under the Integrated Child<br \/>\nDevelopment Scheme is required to be made on the local basis i.e.<br \/>\nonly local candidates are appointed to be Anganwadi workers. The said<br \/>\npolicy has since been altered by the Government Resolution dated 10th<br \/>\nSeptember, 2008. In case of<br \/>\nthe selection pursuant to the aforesaid advertisement dated 12th<br \/>\nMay, 2008, the respondent   Child Development Project Officer has<br \/>\napplied the modified policy of 10th September, 2008 and<br \/>\nhas selected the concerned respondent ignoring the right of the<br \/>\nappellants.\n<\/p>\n<p>\tThe<br \/>\nlearned Single Judge has dismissed the writ petitions. According to<br \/>\nthe learned Single Judge the Government Resolution dated 10th<br \/>\nSeptember, 2008 does not contain a new or modified policy for<br \/>\nselection and appointment of Anganwadi workers but it merely explains<br \/>\nwhat the words &#8216;local candidate&#8217; mean. Therefore, the present<br \/>\nAppeals.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr.Pujara has appeared for the appellants. He has taken us<br \/>\nthrough the various circulars and resolutions issued in respect of<br \/>\nappointment of Anganwadi workers. He has submitted that since 1994 it<br \/>\nis the policy of the State Government to appoint Anganwadi workers<br \/>\nfrom amongst the local candidates. A deviation has been made for the<br \/>\nfirst time by impugned Resolution issued on 10th<br \/>\nSeptember, 2008. He has submitted that under the aforesaid Resolution<br \/>\ndated 10th September, 2008 not only the local candidates<br \/>\nbut the candidates of other villages which constitute one common gram<br \/>\npanchayat have also been made eligible for appointment as Anganwadi<br \/>\nworkers. He has submitted that it is the settled proposition of law<br \/>\nthat once the advertisement is issued and recruitment procedure is<br \/>\nstarted, any alteration in the recruitment rules or procedure shall<br \/>\nnot affect the recruitment which has already been commenced. In the<br \/>\npresent case, the concerned respondent no.4 has been selected in<br \/>\nviolation of the aforesaid principle. In the submission of Mr.Pujara,<br \/>\nthe learned Single Judge has erred in not appreciating the contention<br \/>\nin its correct perspective.\n<\/p>\n<p>\tWe<br \/>\nare unable to agree with Mr.Pujara. It is true that it is the policy<br \/>\nof the State Government to appoint Anganwadi workers from amongst the<br \/>\nlocal candidates and that is the policy which is reiterated under the<br \/>\nGovernment Resolution dated 10th September, 2008. We have<br \/>\nconsidered the nature of services rendered at Anganwadi centres and<br \/>\nthe functions of an Anganwadi worker. In that context, in our<br \/>\nopinion, the words &#8216;local candidate&#8217; would necessarily mean a<br \/>\ncandidate who resides within the revenue limits of the village in<br \/>\nwhich the Anganwadi centre is situated.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr.Munshaw has demonstrated before us that the candidates<br \/>\nselected do reside within the revenue limits of the village in which<br \/>\nthe concerned Anganwadi centre is situated.\n<\/p>\n<p>\tFor<br \/>\nthe aforesaid reasons, we see no substance in these Appeals. The<br \/>\nAppeals are dismissed in limine.
