Justice ANTONY DOMINIC\n\n Dated :31\/10\/2008\n\n O R D E R\n                        ANTONY DOMINIC, J.\n\n                 = = = = = = = = = = = = = = =\n                 =W.P.(C) = = = = = = = = = = =\n                          No. 29643 OF 2008 D\n                   = = =\n\n\n              Dated this the 31st day of October 2008\n\n\n                          J U D G M E N T\n<\/pre>\n<p>      The petitioner who is presently working as a senior resident in<\/p>\n<p>the T.D. Medical College, Alappuzha, wanted a posting near to her<\/p>\n<p>place of residence at Kochi. Accordingly, on a request made by the<\/p>\n<p>petitioner Ext. P6 order was issued by the 3rd respondent,<\/p>\n<p>transferring her to Ernakulam District and posting her at the Taluk<\/p>\n<p>Headquarters Hospital, North Parur for a period of 2 years. Despite<\/p>\n<p>Ext. P6 she was not relieved by the Principal of the Medical College<\/p>\n<p>and with that grievance the writ petition was filed.<\/p>\n<p>      2. The learned Govt. Pleader has entered appearance.<\/p>\n<p>According to the learned Govt. Pleader, the transfer effected by the<\/p>\n<p>3rd respondent was incompetent in view of the Govt. Order dated<\/p>\n<p>26.2.2008. It is also stated that in view of the acute shortage of<\/p>\n<p>Doctors in the Department of Anaesthesiology in the T.D. Medical<\/p>\n<p>College, Alleppey, the Director of Medical Education by his<\/p>\n<p>W.P.(C) No. 29643 OF 2008<br \/>\n<span class=\"hidden_text\">                                 -2-<\/span><\/p>\n<p>communication dated 10.10.2008 requested the 3rd respondent for<\/p>\n<p>cancellation of Ext. P6. Accordingly, the 3rd respondent has issued<\/p>\n<p>order dated 28.10.2008 the relevant portion of which reads as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>             &#8220;Since then the Director of Medical Education has<br \/>\n     strongly represented to the State Mission Director,<br \/>\n     National Rural Health Mission toas   retain her at Medical<br \/>\n     College,<br \/>\n     Anaesthesiologists.is Consideringacutetheshortage the<br \/>\n                   Alappuzha    itself              Dept.    of<br \/>\n     Anaesthesiology           facing                        of<br \/>\n                                           the gravity of<br \/>\n     situation at Medical College Alappuzha the earlier order<br \/>\n     No. NRHM\/Ad,mn1\/3082\/08\/SPMSU dated 26.9.2008<br \/>\n     will be effectuated and she will be relieved from Medical<br \/>\n     College, Alappuzha only when a substitute is posted<br \/>\n     and joined.&#8221;<\/p><\/blockquote>\n<p>      3. In view of the order dated 28.10.2008 issued by the 3rd<\/p>\n<p>respondent as above, this Court will not be justified in directing<\/p>\n<p>that the petitioner be relieved at this stage. However, it is directed<\/p>\n<p>that as and when a substitute is posted in her place and the<\/p>\n<p>substitute joining the post the direction in the order dated<\/p>\n<p>28.10.2008 that the petitioner will be relieved in pursuance to Ext.<\/p>\n<p>P6, shall be implemented.\n<\/p>\n<p>      4. Petitioner secured Post Graduate admission by furnishing a<\/p>\n<p>bond, undertaking to serve the Government after her course. It is<\/p>\n<p>W.P.(C) No. 29643 OF 2008<br \/>\n<span class=\"hidden_text\">                                 -3-<\/span><\/p>\n<p>in pursuance to the said obligation, that she is posted at the<\/p>\n<p>Medical College.      She has a case that the bond is liable to be<\/p>\n<p>quashed as it violates her fundamental rights. She is also pleading<\/p>\n<p>for equal pay as against the consolidated pay that is now being<\/p>\n<p>given.     However, the Government have issued order dated<\/p>\n<p>7.10.2008, revising the terms of Doctors like the petitioner and<\/p>\n<p>since the learned Addl.
