No.11071 of 2011\n                                       Bharat Kumar\n                                           Versus\n                                    The State Of Bihar\n                                         -----------\n<\/pre>\n<p>04   30.06.2011              Heard learned counsel for the petitioner as well as<\/p>\n<p>                   learned Additional Public Prosecutor for the State.<\/p>\n<p>                                 Petitioner is husband of the deceased and it is<\/p>\n<p>                   stated that he committed the murder of deceased for lust of<\/p>\n<p>                   dowry but submission on behalf of the petitioner is that deceased<\/p>\n<p>                   was caught in fire accidentally while she was cooking meal and<\/p>\n<p>                   immediately she was taken to the clinic of Dr. Chittranjan at<\/p>\n<p>                   Sasaram who referred the deceased to Banaras for better<\/p>\n<p>                   treatment and, thereafter, deceased was taken to Banaras where<\/p>\n<p>                   she was got admitted in Jagrity Hospital but she succumbed to<\/p>\n<p>                   her burn injuries on the next day and, thereafter, her dead body<\/p>\n<p>                   was cremated at Banaras in presence of informant as well as his<\/p>\n<p>                   other family members. It is contended by learned counsel for the<\/p>\n<p>                   petitioner that witnesses have stated the aforesaid fact before the<\/p>\n<p>                   Investigating Officer but the Investigating Officer did not take<\/p>\n<p>                   pain to verify the aforesaid fact rather in very haste manner<\/p>\n<p>                   submitted charge sheet against the petitioner and some other<\/p>\n<p>                   persons.\n<\/p>\n<p>                                 Para-47 of the case diary reveals that investigation<\/p>\n<p>                   has been kept pending in respect of other co-accused persons.<\/p>\n<p>                                 In view of the aforesaid circumstance, I think it<\/p>\n<p>                   proper to call for the complete case diary of Sasaram (Darigaon)<\/p>\n<p>                   P.S. Case No. 813 of 2010 from the court of Chief Judicial<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>          Magistrate, Rohtas at Sasaram.\n<\/p>\n<p>                        Accordingly, the complete case diary of Sasaram<\/p>\n<p>          (Darigaon) P.S. Case No. 813 of 2010 be called for from the<\/p>\n<p>          court of Chief Judicial Magistrate, Rohtas at Sasaram.
