      Petitioner was an employee of KSEB. He approached<\/p>\n
the controlling authority under the Payment of Gratuity Act<\/p>\n
for gratuity in terms of the provisions of Payment of Gratuity<\/p>\n
Act. He is aggrieved by the inordinate delay in release of the<\/p>\n
balance amount of gratuity kept in deposit with the Appellate<\/p>\n
Authority, the 1st respondent, even after dismissal of the<\/p>\n
appeal filed by the Board in gratuity case relating to the<\/p>\n
petitioner. The Board has not challenged the orders passed<\/p>\n
by the authority concerned.\n<\/p>\n<\/p>\n
2.    A Division      Bench of this Court KSEB              v.\n<\/p>\n
Mohankumar(2008 (3) KLT 73) held that the employees<\/p>\n
of the Electricity Board are entitled to gratuity under the<\/p>\n
provisions of Payment of Gratuity Act. It seems that the<\/p>\n
Board has preferred an appeal before the Supreme Court.<\/p>\n
Notice has been issued on the Special Leave Petition and an<\/p>\n
order on such petition       has been passed, points out the<\/p>\n
learned counsel for the Electricity Board. He also refers to<\/p>\n

\n                                2<\/span><\/p>\n
the judgment of the Division Bench of this Court in<\/p>\n
W.A.439\/2009 directing that the additional gratuity amount<\/p>\n
found due to the writ petitioner in the said case shall be<\/p>\n
released to him on him executing a bond along with two<\/p>\n
serving employees of the Board to refund the amount, if the<\/p>\n
decision of the apex Court is in favour of the Board. Amount<\/p>\n
was directed to be released to the writ petitioner within four<\/p>\n
months from the date of receipt of a copy of the judgment<\/p>\n
namely 6.4.2009. The Special Leave Petition pending before<\/p>\n
the Supreme Court is not yet disposed of. Learned counsel<\/p>\n
for the Board submits that similar direction may be issued in<\/p>\n
relation to the petitioner in the instant case.<\/p>\n
3.    Learned counsel for the petitioner submits that the<\/p>\n
petitioner is a retired employee of the Board and serving<\/p>\n
employees of the Board are not willing to stand as surety.<\/p>\n
He is willing to execute the bond that if the Supreme Court<\/p>\n
ultimately takes a decision holding that the employees of the<\/p>\n
Board are not entitled to gratuity under the Payment of<\/p>\n
Gratuity Act, they shall refund the amount paid to them.<\/p>\n

4.    I find force in the submission made by the learned<\/p>\n
counsel for the petitioner that the serving employees of the<\/p>\n
Board may not be likely to stand as a surety for a retired<\/p>\n
employee and I also take note of the fact that in the instant<\/p>\n
case, the petitioner only claims the benefit of orders passed<\/p>\n
by the competent authority under the Payment of Gratuity<\/p>\n
Act. Such orders have become final as on date. Petitioner, a<\/p>\n
retired employee, cannot be asked to wait for the benefit,<\/p>\n
because according to the Board, the question of law has been<\/p>\n
agitated before the Supreme Court.         If  the Board was<\/p>\n
aggrieved by the order passed by the authority under the<\/p>\n
Act, Board should have independently challenged the said<\/p>\n
order, before this Court. That has not been done.<\/p>\n
5.    Petitioner is entitled to interest   as awarded by the<\/p>\n
controlling authority under the Act. But in circumstances<\/p>\n
where the issue regarding the eligibility is pending before<\/p>\n
the Supreme Court, payment of interest shall be deferred<\/p>\n
for a specific period.\n<\/p>\n<\/p>\n
6.    In the result, writ petition is disposed of directing the<\/p>\n

\n                              4<\/span><\/p>\n
appellate authority under the Payment of Gratuity Act to<\/p>\n
disburse to the petitioner the amount deposited by the<\/p>\n
Electricity Board with such authority as gratuity payable to<\/p>\n
the petitioner, on production of a copy of this judgment.<\/p>\n
Board shall pay the interest as directed by the competent<\/p>\n
authority under the Payment of Gratuity Act provided the<\/p>\n
order passed by the authority has become final. Board shall<\/p>\n
be permitted to six months’ time from today to pay the<\/p>\n
interest and if within the said period, the issue as regards<\/p>\n
the eligibility of retired employees of the Board to receive<\/p>\n
gratuity under the Act is yet to be decided by the Supreme<\/p>\n
Court, then the Board shall pay interest as directed by the<\/p>\n
competent authority on condition that the petitioner<\/p>\n
executes a bond agreeing to refund the interest portion, if<\/p>\n
ultimately the issue is   decided in favour of the Board, by<\/p>\n
the Honourable Supreme Court.          Such bond shall be<\/p>\n
executed on a 50 rupees stamp paper.\n<\/p>\n<\/p>\n
