Akhilesh Chandra, J.                 The sole appellant has preferred this<\/p>\n
                         appeal against his conviction under section<\/p>\n
                         20(b)(ii)(c) of the N.D.P.S. Act and sentence to<\/p>\n
                         undergo rigorous imprisonment for ten years and<\/p>\n
                         pay a fine of Rs. 1,00,000\/- in default of<\/p>\n
                         payment of fine further rigorous imprisonment<\/p>\n
                         for two years awarded by learned 1st Additional<\/p>\n
                         Sessions     Judge,    Sitamarhi     in   G.R.    No.<\/p>\n
                         445\/99\/Tr. No. 47\/2006(27\/2007).<\/p>\n
                                     2.   The prosecution has reveal from<\/p>\n
                         Ext.3, the self written statement of S.I. Shyam<\/p>\n
                         Sundar Singh (P.W.5) recorded at 1.00 A.M. on<\/p>\n
                         31.08.1999 at the door of appellant in village
\n               2<\/span><\/p>\n
Chainpura, P.S. – Pupri, district – Sitamarhi, is<\/p>\n
that at about 10.10 P.M.     on 30.09.1999 the<\/p>\n
informant got a confidential information that<\/p>\n
there is Nepali Ganja lying in the house of the<\/p>\n
appellant in huge quantity and it is likely to be<\/p>\n
disposed of, immediately on recording sanha no.<\/p>\n
583 (not on record) the raiding party was<\/p>\n
conducted under the leadership of the informant,<\/p>\n
wherein Ajay Kumar Singh (P.W.6) and two<\/p>\n
chowkidar namely, Shrawan Rai (P.W.1) and<\/p>\n
Satya Narayan Paswan (P.W.2) besides Ajay<\/p>\n
Kumar Singh (P.W.6) were members. The raiding<\/p>\n
party arrived at the place of occurrence at about<\/p>\n
12.00 P.M. and found four persons fleeing, out of<\/p>\n
whom three, the appellant Surendra Kumar @<\/p>\n
Ram babu Rai, Nagendra Bhagat and Dhorai Rai<\/p>\n
(two acquitted accused) could be apprehended<\/p>\n
and one Net Lal Rai (father of appellant and<\/p>\n
acquitted acused) successfully escaped. The raid<\/p>\n
was conducted in the house of the appellant and<\/p>\n
from the southern room behind a bed concealed<\/p>\n
under carpet eight packets in one plastic bag of<\/p>\n
Ganja weighted 150 kg were recovered and the<\/p>\n
persons apprehended failed to produce any valid<\/p>\n
document. Search was conducted in presence of
\n                 3<\/span><\/p>\n
villagers Nawal Rai         (P.W.4) and Ram Lalit Rai<\/p>\n
(P.W.3) and Seizure list was prepared, article was<\/p>\n
seized and on the basis of this statement at<\/p>\n
Police Station, Pupri P.S. Case No. 130\/99 was<\/p>\n
registered under sections 22\/23 of the N.D.P.S.<\/p>\n
Act. After investigation, police submitted charge<\/p>\n
sheet under section 22\/23 of N.D.P.S. Act<\/p>\n
against four persons against whom on taking<\/p>\n
cognizance trial commenced after framing and<\/p>\n
explaining the charge under section 20 of the<\/p>\n
Act.\n<\/p>\n
           3.          In   support   of   prosecution,<\/p>\n
altogether nine witnesses have been examined<\/p>\n
besides producing the following by way of<\/p>\n
documentary evidence:\n<\/p>\n
                    Ext. 1 : Signature of Ram Lalit<\/p>\n
                    Rai (P.W.3) on Seizure list.<\/p>\n
                Ext. 1\/1 : Signature of Ram<\/p>\n
                Babu Rai on the seizure list.<\/p>\n
                Ext. 1\/2 : Signature of Nawal<\/p>\n
                Rai (P.W.4) on the seizure list.<\/p>\n
                Ext. 1\/3 : Signature of Shyam<\/p>\n
                Sundar Singh (P.W.5) on the<\/p>\n
                seizure list.\n<\/p><\/blockquote>\n
                Ext. 2 : Seizure list.
\n                 4<\/span><\/p>\n
                Ext. 3 : Fardbeyan.\n<\/p><\/blockquote>\n
                Ext. 4 : Formal F.I.R.<\/p><\/blockquote>\n

                First Information Report.<\/p>\n
                Ext.5 : Report of F.S.L.<\/p><\/blockquote>\n
           and on consideration whereof three<\/p>\n
persons facing trial were acquitted whereas the<\/p>\n
appellant was convicted and sentenced giving<\/p>\n
rise to present appeal.\n<\/p>\n
           4.       It is submitted on behalf of the<\/p>\n
appellant that there is no evidence to support<\/p>\n
any recovery from the possession of the appellant<\/p>\n
nor the seized article were properly weighed,<\/p>\n
samples were prepared or sent for chemical<\/p>\n
examination even during trial. Nothing could be<\/p>\n
produced rather out of alleged 150 kg of Ganja,<\/p>\n
unsealed 10 kg was produced claiming to be<\/p>\n
seized in the instant case, that apart none of the<\/p>\n
mandatory provisions including section 50 of the<\/p>\n
N.D.P.S. Act has been complied with.<\/p>\n
           5.        On the other hand, learned<\/p>\n
Additional Public Prosecutor while supporting<\/p>\n
the case submitted that prosecution has been<\/p>\n
able to establish the case and compliance of
\n                  5<\/span><\/p>\n
section 50 of the N.D.P.S. Act, which was not at<\/p>\n
all required as the search and recovery was made<\/p>\n
from the house of the appellant.\n<\/p>\n
            6.       Now, it is to be seen in this<\/p>\n
appeal whether the prosecution has been able to<\/p>\n
substantiate the charge against the appellant<\/p>\n
beyond any shadow of reasonable doubt or<\/p>\n
findings   of    the   court   below   requires   any<\/p>\n
interference.\n<\/p>\n
            7.       As per prosecution case, on<\/p>\n
getting information about lying Ganja in huge<\/p>\n
quantity for the purpose of disposal in his house<\/p>\n
belonging to the appellant, one raiding party was<\/p>\n
organized, but from nowhere it appears that any<\/p>\n
superior officer was intimated before proceeding<\/p>\n
in the search. The officer-in-charge was not<\/p>\n
available and there was no member in the<\/p>\n
raiding party said to be a gazetted officer.<\/p>\n
            8.       Shrawan Rai (P.W.1), village<\/p>\n
Chowkidar, has come to say that raid was<\/p>\n
conducted in a hut situated on government land<\/p>\n
south to the residential house of acquitted<\/p>\n
accused Net Lal Rai and in said hut the children<\/p>\n
used to get their studies. In cross examination,<\/p>\n
this witness has said that said hut was erected
\n                  6<\/span><\/p>\n
by villagers for the purpose of education of<\/p>\n
children which was open hut without any door<\/p>\n
etc. Almost similar is the position of another<\/p>\n
chowkidar Satya Narayan Paswan (P.W.2). Both<\/p>\n
these witnesses further speak that seized article<\/p>\n
was brought to police station where papers in<\/p>\n
this regard were brought into existence.<\/p>\n
            9.               Ram Lalit Rai (P.W.3), the<\/p>\n
witness to seizure list, was brought their custody<\/p>\n
to depose during trial comes to say that search<\/p>\n
was made in his presence in the house of the<\/p>\n
appellant   from        where      150   kgs    of   Ganja<\/p>\n
containing eight bags was recovered. Copy of<\/p>\n
seizure list was handed over to the appellant who<\/p>\n
endorsed his signature in receipt and this<\/p>\n
witness also signed upon the same as witness<\/p>\n
and   proved         Exts.     1   and   1\/1.   In   cross<\/p>\n
examination, it has come that this witness is at<\/p>\n
inimical term which all the accused facing trial<\/p>\n
since much before the instant case and was in<\/p>\n
custody in connection with the cases lodged by<\/p>\n
the accused against him. Similar is the position<\/p>\n
of Nawal Rai (P.W.4) full brother of P.W.3. None<\/p>\n
of these two witnesses claimed going to police<\/p>\n
station with the seized articles or the accused
\n                     7<\/span><\/p>\n
apprehended or with the police party and if as<\/p>\n
per earlier two witnesses seizure list etc. was<\/p>\n
prepared at police station, how copy of the same<\/p>\n
can be served upon the appellant at the place of<\/p>\n
recovery. There is nothing to explain.<\/p>\n
                  10.      Shyam Sundar Singh (P.W.5)<\/p>\n
A.S.I.     member of the raiding party and the<\/p>\n
informant, at the relevant time in absence of<\/p>\n
officer-in-charge was in control of the affairs of<\/p>\n
the      police     station.    On     getting    confidential<\/p>\n
information arranged raiding party constituting<\/p>\n
P.Ws. 1, 2, 6 and other constables and Havildars<\/p>\n
when arrived near the house of the appellant,<\/p>\n
four persons tried to escape in which three were<\/p>\n
apprehended. Search was conducted in the<\/p>\n
house of the            appellant and from south of the<\/p>\n
house beneath a palang, eight bags of Ganja was<\/p>\n
recovered which was estimated to be 150 kgs<\/p>\n
(not weighed), seizure list was prepared which is<\/p>\n
in the pen of Ajay Kumar Singh (P.W.6). This<\/p>\n
witness has put his signature on the seizure list<\/p>\n
(Ext.1\/3)     copy        of   which    was      served   upon<\/p>\n
appellant and this witness at about 1.00 A.M. at<\/p>\n
P.O. itself and prepared self statement (Ext.3)<\/p>\n
and entrusted investigation of the case to Ajay
\n               8<\/span><\/p>\n
Kumar Singh (P.W.6) at police station where the<\/p>\n
case was instituted. Formal F.I.R. is Ext.4,<\/p>\n
whereon the officer-in-charge who had arrived,<\/p>\n
meanwhile put his signature (Ext.4\/1).<\/p>\n
           11.    In cross examination, he admits<\/p>\n
that seized articles was brought to police station<\/p>\n
with members of the raiding party who brought<\/p>\n
the same into a Geep, which was weighted at<\/p>\n
police station and thereafter kept in Malkhana,<\/p>\n
but nowhere this witness has said a word about<\/p>\n
concealing of the seized articles or taking out any<\/p>\n
required amount from the same for the purpose<\/p>\n
of sampling and chemical examination. Similar is<\/p>\n
the position of Ajay Kumar Singh (P.W.6) another<\/p>\n
member or raiding party and investigating officer<\/p>\n
who initially tried to said in prosecution case. He<\/p>\n
further speaks about search conducted in the<\/p>\n
respective house of other co-accused Dhorai Rai<\/p>\n
and Nagendra Bhagat, but nothing could be<\/p>\n
recovered, none of other witnesses have said<\/p>\n
anything about such raid being conducted in the<\/p>\n
house of other co-accused (since acquitted).<\/p>\n
Initially charge sheet was submitted against<\/p>\n
three persons including the appellant. However,<\/p>\n
subsequently supplementary charge sheet was
\n                9<\/span><\/p>\n
submitted     against    father   of    the   appellant<\/p>\n
(acquitted). In para 8 of the cross examination,<\/p>\n
this witness admits Pupri being a sub-divisional<\/p>\n
of town where S.D.O. and other executive officers<\/p>\n
besides Dy.S.P., all gazetted officers reside but<\/p>\n
for the reasons best known, none of these were<\/p>\n
available and authorities could be informed. In<\/p>\n
Para 11, this witness speaks about the place<\/p>\n
from where recovery was made. It is nothing but<\/p>\n
an open hut without any door adjacent south of<\/p>\n
residential house of the appellant and there was<\/p>\n
no other article kept therein whereas informant<\/p>\n
(P.W.5) has said that the seized article was kept<\/p>\n
behind a palang. This witness is further specific<\/p>\n
that he has no paper to show the land over<\/p>\n
which the said hut was belongs to the appellant<\/p>\n
or his family. On the point of enmity with other<\/p>\n
two seizure list witnesses this investigating<\/p>\n
officer is silent and in para 18 of the cross<\/p>\n
examination he further gives death nail to the<\/p>\n
prosecution case while saying that the seized<\/p>\n
Ganja was kept unsealed in the Malkhana from<\/p>\n
where nine days after i.e. 09.11.1999, sample<\/p>\n
was taken and sent for examination. There is no<\/p>\n
explanation    as   to    why     and    under    what
\n               10<\/span><\/p>\n
circumstances the seized article was not sealed<\/p>\n
nor sample etc. were taken and sealed for<\/p>\n
transmission to chemical examination. There is<\/p>\n
also no explanation for the delay caused in<\/p>\n
sending the article for chemical examination and<\/p>\n
such delay itself creates grave doubt against the<\/p>\n
prosecution version.\n<\/p>\n
           12. Satya Narayan Singh (P.W.7) is a<\/p>\n
formal witness, simply proved Ext.5 the report of<\/p>\n
chemical examiner. Nawal Kishor Verma (P.W.8),<\/p>\n
an A.S.I. and also member of raiding party comes<\/p>\n
to say that search and recovery was made in a<\/p>\n
hut south to the residential house of the<\/p>\n
appellant and it is consistent with the evidence of<\/p>\n
P.Ws. 1, 2 and 6. P.W.9 is constable Radha<\/p>\n
Mohan, attached with police Malkhana brought<\/p>\n
material Exhibit-1 in the court i.e. none else than<\/p>\n
10 kgs of Ganja tagged with a rope without any<\/p>\n
seal or mark to show that the same was seized in<\/p>\n
the instant case as claimed by this witness.<\/p>\n
           13.     All such materials discussed<\/p>\n
above rightly provide room to the learned counsel<\/p>\n
for the appellant to submit that none of the<\/p>\n
mandatory requirement under law has been<\/p>\n
fulfilled in the instant case and the materials are
\n                                            11<\/span><\/p>\n
                             same and similar under which father of the<\/p>\n
                             appellant Net Lal Rai has already been acquitted<\/p>\n
                             by the trial court.\n<\/p>\n
                                         14.    Hence, I find and hold that the<\/p>\n
                             materials available are not sufficient to uphold<\/p>\n
                             the conviction of the appellant. Accordingly, the<\/p>\n
                             conviction and sentence of the appellant is set<\/p>\n
                             aside. This appeal is allowed. The appellant, who<\/p>\n
                             is on bail, is discharged from the liability of the<\/p>\n
                             bail bond furnished on his behalf.<\/p>\n
