JUSTICE GOPAL PRASAD<\/p>\n<p>Gopal Prasad, J.                On repeated calls no one appears on behalf of<\/p>\n<p>                     the appellant.\n<\/p>\n<p>                                2. Mr. Arun Kumar Tripathi, Advocate appears<\/p>\n<p>                     and prays that he may be permitted to appear in this case<\/p>\n<p>                     as Amicus Curiae.\n<\/p>\n<p>                                3. Prayer is allowed.\n<\/p>\n<p>                               4. The appellant has been convicted under<\/p>\n<p>                     Section 7 of the Essential Commodities Act and<\/p>\n<p>                     sentenced to undergo rigorous imprisonment for four<\/p>\n<p>                     months and fine of Rs. 1,000\/- and in default to undergo<\/p>\n<p>                     rigorous imprisonment for two months.<\/p>\n<p>                                5. The order of conviction and sentence recorded<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>                   on the basis of evidence recorded by his predecessor.<\/p>\n<p>                            6. However having regard to the fact that<\/p>\n<p>                   proceeding under Essential Commodities Act is the<\/p>\n<p>                   summary proceeding and only substance of evidence are<\/p>\n<p>                   required to be recorded by the Presiding Officer of<\/p>\n<p>                   Special Court. Hence order of conviction and sentence<\/p>\n<p>                   cannot be recorded on the basis of evidence recorded by<\/p>\n<p>                   the predecessor without recalling the witnesses.<\/p>\n<p>                            7. However, evidence of witnesses has not been<\/p>\n<p>                   recorded by the Presiding Officer.
