Justice K.T.SANKARAN\n\n Dated :12\/03\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 5061 OF 2009\n             ------------------------------------------------------\n              Dated this the 12th day of March, 2010\n\n\n                                O R D E R\n<\/pre>\n<p>       When the Bail Application came up for hearing on 1.3.2010,<\/p>\n<p>the following order was passed:\n<\/p>\n<\/p>\n<blockquote><p>              &#8220;This is an application for anticipatory bail under<\/p>\n<p>       Section 438 of the Code of Criminal Procedure. The<\/p>\n<p>       petitioners are accused Nos.1 and 2 in Crime<\/p>\n<p>       No.352\/2009 of Thamarassery Police Station.<\/p>\n<\/blockquote>\n<blockquote><p>             2.     The offences alleged against the petitioners<\/p>\n<p>       are under Sections 323 and 333 of the Indian Penal<\/p>\n<p>       Code and Section 3(1) of the P.D.P.P Act.<\/p>\n<\/blockquote>\n<blockquote><p>             3.     The prosecution case is that the accused<\/p>\n<p>       attacked the de facto complainant, while on duty, who<\/p>\n<p>       was working as a conductor in a K.S.R.T.C. Bus.<\/p><\/blockquote>\n<p>             4.     When the Bail Application came up for<\/p>\n<p>       hearing on various dates, it was submitted that as a part<\/p>\n<p>       of the settlement, the driver and conductor of the bus<\/p>\n<p>       were compensated, as a result of the mediation talk held<\/p>\n<p>B.A. NO. 5061 OF 2009<\/p>\n<p>                                   :: 2 ::\n<\/p>\n<p>      at the instance of the Trade Union Leaders. It was also<\/p>\n<p>      submitted    that   the  petitioners   are    prepared    to<\/p>\n<p>      compensate the K.S.R.T.C for the loss sustained by<\/p>\n<p>      them. The first petitioner has filed an affidavit and stated<\/p>\n<p>      thus:\n<\/p>\n<\/p>\n<p>             &#8220;On 9\/10\/2009 myself, second petitioner and our<\/p>\n<p>      parents, Sri. George M Thomas, MLA, Varghese Simon<\/p>\n<p>      (Advocate), De facto complainant K.C. Sasi (conductor)<\/p>\n<p>      Sri. Dasan (driver), the KSRTC Union Leader, Sri.<\/p>\n<p>      Pramod, KSRTC Employees Association and other<\/p>\n<p>      Union Members sat together and settled the dispute. As<\/p>\n<p>      per the joint decision taken in the meeting, it was<\/p>\n<p>      decided to give Rs.25,000\/- to the de facto complainant<\/p>\n<p>      and Rs.5,000\/- to driver Dasan. On the same day<\/p>\n<p>      Second Petitioners      father    Mr.  Joseph entrusted<\/p>\n<p>      Rs.30,000\/- to the union leader to          Mr. Pramod. It<\/p>\n<p>      was also decided in the meeting that our parents will<\/p>\n<p>      contact KSRTC officials to compensate the loss and<\/p>\n<p>      settle the claim.\n<\/p>\n<\/p>\n<p>             On the basis of that the second petitioners father<\/p>\n<p>      Mr. Joseph contacted the Hon&#8217;ble minister of Transport<\/p>\n<p>      Sri.  Jose     Thattayal   by   filing a    representation.<\/p>\n<p>      Considering the representation, minister gave direction<\/p>\n<p>      to meet the Managing Director of KSRTC. The second<\/p>\n<p>      petitioners father Mr. Joseph approached the managing<\/p>\n<p>B.A. NO. 5061 OF 2009<\/p>\n<p>                                   :: 3 ::\n<\/p>\n<p>      director KSRTC and accordingly managing director<\/p>\n<p>      given direction to RTO, Kozhikode to compute the loss.<\/p>\n<p>             The RTO, Kozhikode calculated the loss at<\/p>\n<p>      Rs.15,000\/-, our parents was ready to meet the loss but<\/p>\n<p>      RTO, kozhikode is not ready to accept the money<\/p>\n<p>      because there is a charge against us under PDPP Act<\/p>\n<p>      hence the RTO want a specific direction to receive the<\/p>\n<p>      amount. We are ready to compensate the loss of<\/p>\n<p>      KSRTC to the tune of Rs.15,000\/-. We already paid<\/p>\n<p>      Rs.30,000\/- to Mr. Pramod as he was the mediator.&#8221;<\/p>\n<p>             5.    In the facts and circumstances of the case, I<\/p>\n<p>      am of the view that before disposing of the Bail<\/p>\n<p>      Application, an opportunity should be given to the<\/p>\n<p>      petitioners to appear before the investigating officer.<\/p>\n<p>      Accordingly, there will be a direction to the petitioners to<\/p>\n<p>      appear before the investigating officer at 9 A.M. on 8th<\/p>\n<p>      March, 2010.\n<\/p>\n<\/p>\n<p>             6.    Post on 12\/03\/2010.\n<\/p>\n<\/p>\n<p>             7.    It is submitted by the learned Public<\/p>\n<p>      Prosecutor that the petitioners will not be arrested until<\/p>\n<p>      further orders in connection with Crime No. 352 of 2009<\/p>\n<p>      of Thamarassery Police Station.\n<\/p>\n<p>B.A. NO. 5061 OF 2009<\/p>\n<p>                                      :: 4 ::\n<\/p>\n<p>              The petitioners shall produce a copy of this order<\/p>\n<p>       before the investigating officer.&#8221;<\/p>\n<p>      2. It is submitted by the learned counsel for the petitioners as<\/p>\n<p>well as the learned Public Prosecutor that the direction in the order<\/p>\n<p>dated 1.3.2010 has been complied with by the petitioners.<\/p>\n<p>      3. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and also taking note of the fact that<\/p>\n<p>the direction in the order dated 1.3.2010 has been complied with by<\/p>\n<p>the petitioners, I am of the view that anticipatory bail can be granted<\/p>\n<p>to the petitioners. There will be a direction that in the event of the<\/p>\n<p>arrest of the petitioners, the officer in charge of the police station<\/p>\n<p>shall release them on bail on their executing bond for Rs.10,000\/-<\/p>\n<p>each with two solvent sureties for the like amount to the satisfaction<\/p>\n<p>of the officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>       a)     The petitioners shall appear before the investigating<br \/>\n              officer for interrogation as and when required;<\/p>\n<\/blockquote>\n<blockquote><p>       b)     The petitioners shall not try to influence the prosecution<br \/>\n              witnesses or tamper with the evidence;<\/p>\n<\/blockquote>\n<blockquote><p>       c)     The petitioners shall not commit any offence or indulge<br \/>\n              in any prejudicial activity while on bail;<\/p>\n<\/blockquote>\n<p>B.A. NO. 5061 OF 2009<\/p>\n<p>                                    :: 5 ::\n<\/p>\n<\/p>\n<p>      d)     In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                   (K.T.SANKARAN)<br \/>\n                                                           Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Gladson Mathew vs The Station House Officer on 12 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5061 of 2009() 1.
